FIRST READiNG OF ORDiNANCE 04-1119 - AMENDMENT TO THE CITY <br /> <br />CODE, CHAPTER 10 - OPEN CONTAiNERS OF ALCOHOL <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to read Ordinance 04-1119 <br />by title only. Motion was seconded by Commissioner <br />Hart. Motion carried unanimously by voice vote. <br /> <br />The City Clerk read Ordinance 04-1119 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />OPEN OR UNSEALED ALCOHOLIC BEVERAGES; ESTABLISHING SECTION 10-9, <br />"THE CASSELBERRY OPEN OR UNSEALED ALCOHOLIC BEVERAGE CODE"; OF <br />CHAPTER 10 OF THE CITY CODE OF ORDINANCES; PROVIDING FOR <br />DEFINITIONS; PROVIDING FOR POSSESSION OR CONSUMPTION PROHIBITED; <br />INAPPLICABILITY/EXCEPTIONS; AND ENFORCEMENT; AND PENALTY; <br />PROVIDING FOR SEVERAB1LITY, CODIFICATION, CONFLICTS AND EFFECTIVE <br />DATE." <br /> <br />Staff Presentation: Chief Pavlis stated Ordinance 04-1119 provides for prohibition of alcoholic beverage <br />open containers or unsealed alcoholic beverage in public or semi-public parking lots and public or semi- <br />public highways. Staffreeommended approval of Ordinance 04-1119 on first reading. <br /> <br />Audience Participation: <br /> <br />1 ) John Casselberry, 700 South Lost Lake Lane, inquired if Ordinance 04-1119 would affect <br />private property. It was clarified that Ordinance 04-1119 would only apply to public rights- <br />of-way and si dewalks in reference to private property and specifically exempts b lock panics. <br /> <br />Commission Discussion: Vice Mayor Clark suggested the following correction to Section C(7): The <br />possession of any open or unsealed container of alcoholic beverage by any duly ordained or authorized <br />minister, paster, priest, rabbi, or any other similarly designated person, or any religious monastery, church <br />or religious body, but only for purposes specifically related to th,k the._~fulfillment Qf their religious duties. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to approve Ordinance 04- <br />1119 on first reading as corrected. Motion was <br />seconded by Commissioner Doerncr. Motion carried <br />unanimously by roll call vote. <br /> <br /> <br />
