CASSELBERRY CITY COMMISSION <br />Minutes of January 12, 2004 - Regular Meeting <br />Page 4 of 24 <br /> <br />The City Clerk read Ordinance 03-1110 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />ANNEXATION; MAKING FINDINGS; ANNEXING TO AND INCLUDING WITHIN <br />THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA, CERTAIN <br />LANDS LOCATED IN SECTION 20, TOWNSHIP 21 S, RANGE 30E; REDEFINING THE <br />CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING <br />FOR THE INTERIM PROVISION OF LAND DEVELOPMENT REGULATIONS; <br />PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING THEIR <br />BUSINES S, TRADE OR PROFESSION WITHIN THE LANDS TO BE ANNEXED MAY <br />CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR PROFESSION <br />THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE NECESSITY OF <br />FURTHER QUALIFICATION THEREFORE; PROVIDING THAT EFFECTIVE IN <br />ACCORDANCE WITH LAW, THE LANDS TO BE ANNEXED SHALL BE ASSESSED <br />FOR PAYMENT OF MUNICIPAL AD VALOREM TAXES; DIRECTING THE CITY <br />CLERK TO FILE CERTIFIED COPIES OF THE ORDINANCE WITH THE CLERK OF <br />COURT AND THE SECRETARY OF STATE OF THE STATE OF FLORIDA; AND <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE." <br /> <br />Legal Advertisement: The Notice of Public Hearing relative to Ordinance 03-1110 was published in the <br />Orlando Sentinel on December 28, 2003 and January 4, 2004. <br /> <br />Staff Presentation: Mr. Wells stated Ordinance 03-1110 provides for annexation of the Regency Oaks <br />property located on the south side of SR 436, approximately 1/10 ora mile northwest of Wilshire Boulevard <br />and 2/10 ora mile southeast of Fern Park Boulevard. The subject property is approximately 20 acres and <br />contains a 343-unit apartment complex. The subject property is adjacent to the City limits, will not create <br />an enclave and generally meets the statutory criteria for annexation as established in Chapter 171, Florida <br />Statutes. Staffrecommended approval of Ordinance 03-1110 on second reading. <br /> <br />Public Hearing: Mayor Pronovost asked if there was anyone in the audience that wished to speak either for <br />or against Ordinance 03-1110. No one came forward. Mayor Pronovost closed the public hearing. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to approve Ordinance 03- <br />1110 on second and final reading as presented. Motion <br />was seconded by Commissioner Hart. Motion carried <br />unanimously by roll call vote. <br /> <br />Roll Call Vote of the City Commission: <br /> <br /> Commissioner Doerner - Yes; Commissioner Cook - Yes; Commissioner Hart - Yes; Vice Mayor <br /> Clark - Yes; Mayor Pronovost - Yes.
