<br />CASSELBERRY CITY COMMISSION <br />Minutes of February 26, 2007 - Regular Meeting <br />Page 6 of 10 <br /> <br />Audience Participation: The following individual requested an opportunity to address the City Commission <br />with regard to Resolution 07-1766: <br /> <br />I) John Casselberry, 700 South Lost Lake Lane, voiced concerns regarding the new traffic <br />movements from the proposed realignment and whether or not the Melody Lane roundabout <br />will allow sufficient turning radius for tractor trailers to maneuver. <br /> <br />MOTION: <br /> <br />Vice Mayor Doerner moved to approve Resolution 07- <br />1766 as presented. Motion was seconded by <br />Commissiouer Solomon. Motion carried unanimously <br />by voice vote 5 - O. <br /> <br />B. RESOLUTION 07-1769 - HOLD HARMLESS AGREEMENT WITH SEMORAN <br />ASSOCIATES. LTD. FOR HOWELL BRANCH CORNERS. 2535 HOWELL <br />BRANCH ROAD <br /> <br />The City Clerk read Resolution 07-1769 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING A <br />RELEASE, HOLD HARMLESS AND INDEMNIFICATION AGREEMENT BETWEEN <br />THE CITY OF CASSELBERRY AND SEMORAN ASSOCIATES, LTD. FOR THE <br />HOWELL BRANCH CORNERS DEVELOPMENT; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Ms. Barbara Lipscomb, City Manager, stated Resolution 07-1769 amends a hold <br />harmless agreement previously approved by Resolution 06-1732. The applicant is requesting to amend <br />Sections 2 and 3 of the agreement to allow the issuance of certificates of occupancy to all but the last tenant <br />in the multi-tenant building prior to recording the final plat. The agreement releases, holds the City harmless <br />and indemnifies the City against any claims, liabilities, losses, obligations, damages, penalties or costs, <br />including reasonable legal fees arising from the issuance of the certificates of completion. The fmal plat for <br />the site received a positive recommendation from the Planning & Zoning Commission on February 14,2007, <br />however, due to minor outstanding issues with accompanying documentation for the final plat, it can not be <br />presented to the City Commission for final approval until March. <br /> <br />Budget Impact: This item does not impact the budget. <br /> <br />Recommendation: The City Manager and Acting Community Development Director recommend approval <br />of Resolution 07-1769 as presented. <br /> <br />MOTION: <br /> <br />Commissioner Hufford moved to approve Resolution <br />07-1769, as presented. Motion was seconded by <br />Commissioner Miller. Motion carried unanimously by <br />voice vote 5 - O. <br />
