<br />CASSELBERRY CITY COMMISSION <br />Minutes of February 26, 2007 - Regular Meeting <br />Page S of 10 <br /> <br />MOTION: <br /> <br />Vice Mayor Doerner moved to approve Ordinance 07- <br />1210 on second and final reading, as presented. <br />Motion was seconded by Commissioner Hufford. <br />Motion carried unanimously by voice vote 5 - O. <br /> <br />10. FIRST READING OF ORDINANCES <br /> <br />No ordinances were presented for first reading. <br /> <br />11. RESOLUTIONS <br /> <br />A. RESOLUTION 07-1766 - LAND EXCHANGE AGREEMENT BETWEEN <br />TARGET CORPORATION AND THE CITY OF CASSELBERRY <br /> <br />The City Clerk read Resolution 07-1766 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A LAND EXCHANGE AGREEMENT BETWEEN TARGET <br />CORPORATION AND THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Mr. Ed Torres, Public Works Director, stated Resolution 07-1766 provides for a land <br />exchange agreement with Target for the Triplet Lake Drive and U.S. Highway 17-92 Intersection <br />Improvements Project. These parcels are required for additional right-of-way for the new realigned entrance <br />into Target at the intersection and connecting back to the new roundabout at Melody Lane. Additionally, <br />this agreement provides two separate temporary construction licenses to the City in order to reconstruct part <br />ofT arget' s existing stormwater maintenance system and existing customer parking lot, and provide adequate <br />area for constructing a new customer parking lot to replace those spaces lost due to the new realignment. <br />The new parking lot will be located west ofthe existing City water tower on Melody Lane. The agreement <br />also provides for the City to convey an off-site signage easement to Target for the relocation of an existing <br />large monument Target sign to a location just north of the present location, and the City to provide Target <br />with a second small monument sign to be located at the Melody Lane entrance to the store. Approval of this <br />agreement avoids the costly and detrimental affects of condemnation proceedings to acquire the parcels for <br />the realignment project. <br /> <br />Budget Impact: The agreement obligates the City to pay for all title/closing services for the mutual <br />conveyance of real property to each entity, and for additional professional survey services required for a <br />future replat of the Target store parent tract. Both entities are responsible for their own legal costs. <br />Estimated total costs including legal fees is between $20,000 - $40,000. Required funds are 10 be allocated <br />from the Capital Improvement Fund - Infrastructure Surtax Fund (114-0710-541-63.43). <br /> <br />Recommendatiou: The City Manager and the Public Works Director recommend approval of Resolution <br />07-1766 as presented. <br />
