SECOND READING OF ORDINANCE 06-1204 - AMENDING ULDR SECTION <br />2-7.26(0)(1 )(i), POOL ENCLOSURES WITHIN THE SEMINOLABOULEV ARD <br />OVERLA YDISTRICTDESIGN STANDARDS TO PROVIDE A LOCATION FOR <br />AIR CONDITIONING AND POOL EOUIPMENT AT THE REAR OF <br />RESIDENTIAL UNITS AND ALSO ALLOW ADEOUA TE USE OF PATIO AND <br />POOL AREAS <br /> <br />The City Clerk read Ordinance 06-1204 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART <br />III, CHAPTER II, DISTRICT AND GENERAL REGULATIONS, ARTICLE VII, <br />SECTION 2-7.26(D)(1)(j)(2) OF THE CASSELBERRY CODE OF ORDINANCES <br />ENTITLED "POOL ENCLOSURES" WITHIN THE SEMINOLA BOULEVARD <br />OVERLAY DISTRICT (SBOD); AMENDING THE SETBACK REQUIREMENT; <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND AN <br />EFFECTIVE DATE." <br /> <br />Legal Advertisement: The notice of public hearing relative to Ordinance 06-1204 was published in the <br />Orlando Sentinel on September 14, 2006. <br /> <br />Staff Presentation: Sandra Smith, Acting Community Development Director, stated Ordinance 06-1204 <br />provides for amending the setback design requirement for the Seminola Boulevard Overlay District (SBOD) <br />for screen enclosures. The initial request for the amendment was made by Centex Homes, the residential <br />developer within the Legacy Park Planned Development. The City Commission approved Ordinance 06- <br />1204 on first reading on August 28, 2006. <br /> <br />Budget Impact: This amendment does not affect the City's budget. <br /> <br />Recommendation: The Interim City Manager and the Acting Community Development Director <br />recommended approval of Ordinance 06-1204 as presented. <br /> <br />Public Hearing: Mayor Goff opened the public hearing for Ordinance 06-1204. No one came forward. <br />Mayor Goff closed the public hearing. <br /> <br />MOTION: <br /> <br />Commissioner Doerner moved to approve Ordinance <br />06-1204 on second and final reading as presented. <br />Motion was seconded by Commissioner Hufford. <br />Motion carried unanimously 5 - 0 by voice vote. <br />
