Mayor Goff stated that <br />there were state laws that covered the sale of surplus property by government entities. Mr. <br />Casselberry suggested the City utilize MAl appraisers. <br /> <br />MOTION: Commissioner Doerner moved to approve Resolution <br />06-1714 as presented. Motion was seconded by <br />Commissioner Hufford. <br /> <br />DISCUSSION: Mayor Goff requested adding in between items 6) and 7) ofthe Policy and <br />Procedures that the City Commission be given notice of transmittal of an <br />offer when an offer is on the table. Mayor Goff stated in the past there <br />were numerous offers rejected by staff that never made it to the City <br />Manager or the City Commission. Lengthy discussion ensued regarding <br />Mayor Goffs request and the role of the City Manager in negotiation of <br />contracts as well as interference by members ofthe City Commission. Vice <br />Mayor Hart and Commissioner Hufford stated they thought the Mayor's <br />request could be accomplished through the Friday letter rather than inserted <br />into the resolution. Mayor Goff passed the gavel to Vice Mayor Hart and <br />made the following amendment to the main motion: <br /> <br />AMENDMENT TO <br />THE MAIN MOTION: <br /> <br />DISCUSSION: <br /> <br />Mayor Goff moved to modify the Policy and Procedures item <br />5) to state "approval" be changed to "by review" and after <br />item 6) a new item be placed stating "Notice shall be given to <br />the Commission of contracts received by a letter oftransmittaI. <br />ofthe Policy and Procedures to state, "The City Manager shall <br />place Award of Bid on the City Commission for their review." <br />Motion was seconded by Commissioner Cook. <br /> <br />Commissioner Cook stated item 5) did not pertain to real estate contracts <br />for offer to purchase but rather contracts with a real estate agent or broker <br />to market the surplus property, and felt item 7) should be the item that is <br />changed to "for review" rather than "approval". Commissioner Cook <br />inquired if it was necessary to require an appraisal prior to sale of surplus <br />property. Mayor Goff stated he thought a specific requirement should be <br />included that there be an appraisal and leave it to the City Manager as to <br />whether it is a market appraisal or MAl appraisal. Mayor Goff further <br />stated that he thought the City Commission should approve the price that <br />the surplus property is listed at on the market. Commissioner Hufford <br />stated she was opposed to those modifications because it was not the role <br />of the City Commission and would tie staffs hands. Vice Mayor Hart <br />stated she did not feel she was qualified to make those types of real estate <br />assessments. Commissioner Doerner concurred with Commissioner <br />Hufford and Vice Mayor Hart. Mr. Miller stated he thought items were <br />being debated weren't necessary and shouldn't be a policy at all at this <br />point. <br />
