<br />City Commission Meeting <br />December 11, 2006 <br />Page 7 <br /> <br />Staff Presentation: Resolution 06- I 741 amends Resolution 05-1558 which outlines the duties ofthe Lakes <br />Management Board. The Board wishes to incorporate language similar to language used in Article 111, <br />Section 66-67 ofthe City Code as it pertains to the Planning and Zoning Commission. The requested change <br />in the delegation of duties for the Lakes Management Advisory Board is under Section 2, Composition, and <br />is as follows: <br /> <br />j) The City Commission may remove any member of the Lakes <br />Management Advisory Board for incompetence, corruption, <br />misconduct, neglect of duty or malfeasance in office, or for unexcused <br />absence from three consecutive meetings of the Lakes Management <br />Advisory Board, or for other good and sufficient cause. <br /> <br />Staff Recommendation: Approval of Resolution 06-1741 as presented. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Susan Doerner to approve Resolution 06-1741, <br />Amendment to delegation of duties for the Lakes Advisory Board as delineated <br />in Exhibit A, Section 2(j) of the resolution. Motion was seconded by <br />Commissioner Colleen S. Hufford and carried on a 5 - 0 vote. <br /> <br />F. Resolution 06-1742 - Department Director Model Employment Agreement <br /> <br />The City Clerk read Resolution 06-1742 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY,FLORIDA,AUTHORlZING <br />THE CITY MANAGER TO UTILIZE A MODEL EMPLOYMENT AGREEMENT <br />WITH DEPARTMENT DIRECTORS; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Resolution 06-1742 will establish an interim policy adopting a Model Employment <br />Agreement for Department Directors which authorizes the City Manager to hire, suspend and terminate <br />Department Directors. With the approval of this resolution, the City Commission temporarily waives its <br />Charter authority regarding Department Directors and gives the City Manager full authority to hire, suspend <br />and terminate managerial employees. A Charter Referendum is required to permanently change this <br />provision of the Charter. With the execution of the EmploymentAgreement, the Directors waive their rights <br />to City Commission involvement in their employment decisions in exchange for benefits such as a severance <br />provision packet. A relocation reimbursement is recommended for new directors. The City Manager is <br />authorized to make further adjustments to the Agreement for each individual Department Director to reflect <br />differences in tenure with the City and other minor matters. The agreement has been reviewed by the Labor <br />Attorney and the City Attorney. The City Attorney stated that if a director challenges the employment <br />agreement and demands the charter right that was taken away by the execution of the agreement, then the <br />entire contract is null and void and they lose their severance rights. <br /> <br />Staff Recommendation: Approval of Resolution 06-1742 as presented is recommended to correct the <br />Charter deficiencies and properly define the Commission/City Manager form of government on an interim <br />basis and to professionalize the employee-employer relationship of directors with the City Manager. <br />
