<br />City Commission Meeting <br />October 9, 2006 <br />Page 6 <br /> <br />PURCHASE OF FOUR PARCELS RELATED TO THE RE-ALIGNMENT OF <br />TRIPLET LAKE DRIVE AND MELODY LANE AND LAKE MANAGEMENT <br />ACTIVITIES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br /> <br />Staff Presentation: Resolution 06-1722 authorizes a contract with Sun Trust Bank, personal representative <br />of the ofthe Hibbard Casselberry Estate and Casselberry Investment Properties, Ltd., for the purchase offour <br />(4) parcels of property necessary for the management of certain City lakes and the construction of the Triplet <br />Lake Drive and Melody Lane roadway/intersection improvements. These properties provide the City with <br />ownership of the lake bottoms for portions of Lake Griffin and Lake Ellen. The legal description and parcel <br />numbers for each of the four parcels are identified in Exhibit "A", which is attached to and made a part of <br />these minutes. The cost forthe purchase of these four parcels is $ 1 6,600; funds are budgeted in the Local <br />Option Gas Tax Fund (109-0710-541.63-43). The parcels were appraised at $18,500 in 2005. <br /> <br />Staff Recommendation: Approval of Resolution 06- I 722 as presented. <br /> <br />Audience Input: John Casselberry, 700 S. Lost Lake Lane, Casselberry, Florida, spoke in opposition to <br />Resolution 06-1722, reiterating the same objections he expressed under the previous item, Resolution 06- <br />1721. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to approve Ordinance 06-1722, <br />Purchase of Four Parcels of Property from the Hibbard Casselberry Estate <br />and Casselberry Investment Properties, Ltd., as presented. Motion was <br />seconded by Commissioner Susan Doerner and carried on a 5 - 0 vote. <br /> <br />C. Resolution 06- I 723 - Expressing Support of Holding a Referendum (Vote) to "Clean up" the City <br />Charter to more closely describe the Commission-Manager Form of Government in Casselberry <br /> <br />The City Clerk read Resolution 06- I 723 by title as follows: <br /> <br />"A RESOLUTION OF THE MA YORAND CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AFFIRMING ITS COMMITMENT TO THE <br />COMMISSION-MANAGER (COUNCIL-MANAGER) FORM OF MUNICIPAL <br />GOVERNMENT; PROVIDING FOR LEGISLATIVE INTENT AND FINDINGS; <br />PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY AND <br />PROVIDING AN EFFECTIVE DATE." <br /> <br />Staff Presentation: Resolution 06- I 723 affirms support for the Comm ission-Manager form of government <br />in the City of Casselberry and expressing support of a Charter referendum to clarify language currently in <br />conflict with the proper functioning ofthe Commission-Manager form of government. The City has not had <br />a Charter review since 1990. Mr. Miller stated that the City Charter references limitations on City Manager <br />authority and this would be an impediment to attracting quality applicants in the selection of a'new City <br />Manager. The approval of Resolution 06- 1 723 would greatly enhance the recruitment and selection process <br />for the new City Manager. <br />
