Resolution 06-1721 - Vacant Land Contract for the Purchase of Six (6) Parcels owned by the Estate <br />of Hibbard Casselberry <br /> <br />The City Clerk read Resolution 06-1721 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA,AUTHORIZING <br />THE EXECUTION OF A CONTRACT WITH SUNTRUST BANK AS PERSONAL <br />REPRESENTATIVE OF THE ESTATE OF HIBBARD CASSELBERRY FOR THE <br />PURCHASE OF SIXP ARCELS RELATED TO THE RE-ALIGNMENT OF NORTH <br />WINTER PARK DRIVE AND LAKE MANAGEMENT ACTIVITIES; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Resolution 06-1721 authorizes a contract with Sun Trust Bank, personal representative <br />of the of the Hibbard Casselberry Estate, for the purchase of six (6) parcels of property necessary for the <br />management of certain City lakes and the construction of North Winter Park Drive. Also, the properties <br />provide the City with ownership of the lake bottoms for portions of Lake Kathryn, all of Lake Crystal Bowl <br />and property to be utilized for storm water retention and environmentally sensitive lands for mitigation <br />purposes in the permitting of the bridge structure crossing Gee Creek. The legal description and parcel <br />numbers for each parcel are identified in Exhibit "A", which is attached to and made a part of these minutes. <br />The cost for the purchase ofthese six parcels is $58,400; funds are budgeted in the Infrastructure Surtax Fund <br />(114-0710-541.63-43). The parcels were appraised at $96,000 in 2005. <br /> <br />Staff Recommendation: Approval of Resolution 06- I 72 I as presented. <br /> <br />Audience Input: John Casselberry, 700 S. Lost Lake Lane, Casselberry, Florida, spoke in opposition to <br />Resolution 06-1721, i.e. the purchasing price was substantially under the appraised value and that he was <br />supposed to have ownership of the lake bottoms. He indicated that as a beneficiary to the Hibbard <br />Casselberry Trust, he had not approved this action. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Susan Doerner to approve Resolution 06-1721, <br />Purchase of Six Parcels of Property from the Hibbard Casselberry Estate, as <br />presented. Motion was seconded by Commissioner Linda Hart and carried on <br />a 5 - 0 vote. <br /> <br />B. Resolution 06-1 722 - Vacant Land Contract for the Purchase ofF our (4) Parcels owned by the Estate <br />of Hibbard Casselberry and Casselberry Investment Properties, Ltd. <br /> <br />The City Clerk read Resolution 06-1722 as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY,FLORlDA, AUTHORIZING <br />THE EXECUTION OF A CONTRACT WITH CASSELBERRY INVESTMENT <br />PROPERTIES, LTD., AND SUNTRUST BANK, AS PERSONAL <br />REPRESENTATIVE OF THE ESTATE OF HIBBARD CASSELBERRY FOR THE <br />
