<br />City Commission Meeting <br />August 28, 2006 <br />Page 4 <br /> <br />Staff Presentation: Ordinance 06-1189 was approved on first reading on August 14,2006. This ordinance <br />provides clear understanding for park users and provides the Police Department and staff with resources <br />necessary to prosecute or fine park abusers. The clerical errors that were identified during the first reading <br />have been corrected and the ordinance is ready for Commission consideration. A resolution relating to <br />policies and procedures for special events will be presented to the City Commission for consideration at a <br />later date. <br /> <br />Staff Recommendation: Approval of Ordinance 06-1189 on second and final reading. <br /> <br />Audience Input - None <br /> <br />MOTION: <br /> <br />Moved by Commissioner Susan Doerner to approve Ordinance 06-1189, Use <br />of City Park Rules, as presented. Motion was seconded by Commissioner <br />Linda Hart. <br /> <br />Commission modified a portion of Section 60-3(h) to state "....No person shall swim, bathe or walk in any <br />"naturar' waters or waterways in or adjacent to any Park...." <br /> <br />VOTE ON THE MOTION: Ordinance 06-1189 was approved on a 5 - 0 vote with the <br />modification in Section 60-3(h) as stated above. <br /> <br />10. First Readinl! of Ordinances: <br /> <br />A. Ordinance 06-1204 - Amending ULDR Section 2-7.26(D)(1 )(j), Pool Enclosures within the <br />Seminola Boulevard Overlay District Design Standards to provide a location for air <br />conditioning and pool equipment at the rear of residential units and also allow adequate use <br />of patio and pool areas <br /> <br />The City Clerk read Ordinance 06-1204 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />PART III, CHAPTER II, DISTRICT AND GENERAL REGULATIONS, ARTICLE <br />VII, SECTION 2-7.26(d)(I)(J)(2) OF THE CASSELBERRY CODE OF <br />ORDINANCES ENTITLED "POOL ENCLOSURES" WITHIN THE SEMINOLE <br />BOULEVARD OVERLAY DISTRICT (SBOD); AMENDING THE SETBACK <br />REQUIREMENT; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br /> <br />Staff Presentation: Ordinance 06-1204 will amend ULDR Section 2-7.26(D)(I)(j) relating to pool <br />enclosures within the Seminola Boulevard Overlay District Design Standards. The request for this change <br />comes from Centex Homes, Developer for the Legacy Park Planned Development. The Planning and Zoning <br />Commission recommended approval of the amendment at an advertised public hearing on August 9, 2006. <br />
