<br />most intense previous land-use on or after February 27th, 2006. For redevelopment of an existing <br />building, it is the City's intent to collect Municipal Services Impact Fees only related to the <br />additional demands upon municipal services over and above the demands attributable to the <br />existing building. <br /> <br />(4) Alternative Fee Calculation. In the event that an applicant believes the impact of the <br />construction will be less than that set forth above, the applicant may, at his option, submit <br />evidence to the City Manager or hislher designee in support of an alternative calculation. Based <br />upon convincing and competent evidence, the City Manager may adjust the impact fee charged <br />to the applicant as appropriate for the particular property and as determined to be in the best <br />interests of the City by the City Manager. <br /> <br />(5) Exemptions. The following shall be exempted from payment of Municipal Services Impact <br />Fees: <br /> <br />a. Alteration or expansion of an existing dwelling unit, or a replacement of an existing <br />dwelling unit with a new dwelling unit. <br /> <br />b. Alteration, replacement, or expansion of an existing building if the projected <br />Municipal Services Impact Fees calculated based upon the building's new land-use is <br />equal to or less than the calculated credit The credit is based upon the original building's <br />most intense previous land-use on or after February 27th, 2006. <br /> <br />c. Construction of publicly owned projects. <br /> <br />Section 55-7. Municipal Services Impact Fee Trust Funds Established. <br /> <br />(I) There are hereby established two (2) non-lapsing trust funds; the Police Services Impact Fee <br />Trust Fund and the Fire Rescue Services Impact Fee Trust Fund. <br /> <br />(2) Municipal Services Impact Fees collected pursuant to this Ordinance shall be segregated into <br />either the Police Services Impact Fee Trust Fund or the Fire Rescue Services Impact Fee Trust <br />Fund, as applicable, and the two (2) trust funds shall not be commingled. <br /> <br />(3) Funds withdrawn from the Police Services Impact Fee Trust Fund or the Fire Rescue <br />Services Impact Fee Trust Fund shall be used in accordance with the provisions of this article. <br /> <br />Section 55-8. Use of Municipal Services Impact Fee Funds. <br /> <br />(I) At least once each fiscal year, the City Manager or designee shall present to the City <br />Commission a proposed capital improvement program for police and fire rescue assigning funds, <br />including any accrued interest from the applicable impact fee trust fund, to specific improvement <br />projects and related capital costs. Monies, including any accrued interest, not assigned in any <br />fiscal year shall be retained in the same impact fee trust fund until the next fiscal year. <br /> <br />(2) Debt Service <br /> <br />Ordinance 06.1179 <br />Page80fJI <br />
