<br />In the event that bonds or other debt instruments are issued for advance provision of police or <br />fire rescue capital requirements for which the Municipal Services Impact Fees were intended to <br />fund the growth related demands, impact fees may be used to pay debt service on such bonds or <br />other debt instruments to the extent that the proceeds of the bonds (and a pro rata share of the <br />cost of issuance) are expended upon the capital facilities. <br /> <br />(3) Police Services <br /> <br />Funds collected for police services impact fees pursuant to this Ordinance shall be used solely <br />for the purpose of acquiring or expanding police services capital equipment and/or facilities <br />under the jurisdiction of the City. <br /> <br />(4) Fire Rescue Services <br />Funds collected for fire rescue services impact fees pursuant to this Ordinance shall be used <br />solely for the purpose of acquiring or expanding fire rescue services capital equipment and/or <br />facilities under the jurisdiction of the City. <br /> <br />Section 55-9. Collection of Unpaid Fees: DelinQuencv. <br /> <br />If the Municipal Services Impact Fees are not paid prior to the issuance of the Certificate of <br />Occupancy because of a mistake or inadvertence on the part of the City, the City shall proceed to <br />collect the Municipal Services Impact Fees as follows: <br /> <br />(I) The City shall serve, by certified mail, return receipt requested, an impact fee statement <br />notice upon the applicant at the address set forth in the application for the Certificate of <br />Occupancy, and the owner at the address appearing on the most recent records maintained by the <br />County property appraiser. Service of the impact fee statement notice shall be deemed notice of <br />the Municipal Services Impact Fees due, and service shall be deemed effective on the date the <br />return receipt indicates the notice was received by either the applicant or the owner, or the date <br />the notice was attached to the Certificate of Occupancy, whichever occurs first. The impact fee <br />statement notice shall contain the legal description of the property, and shall advise the applicant <br />and the owner as follows: <br /> <br />a. The amount due and the general purpose for which the Municipal Services Impact Fees <br />were imposed; <br /> <br />b. The right to submit evidence to support an Altemative Fee Calculation provided by <br />Section 6(4) before the Municipal Services Impact Fees become delinquent; <br /> <br />c. The Municipal Services Impact Fees shall be delinquent if not paid and received by the <br />City within 30 calendar days of the date the impact fee statement notice is received, <br />excluding the date of receipt, and upon becoming delinquent, shall be subject to the <br />imposition of a delinquent fee and interest on the unpaid amount until paid; and <br /> <br />Ordinance 06- J 179 <br />Page 9 of II <br />
