<br />Section 55-4. Applicabilitv. <br /> <br />This article shall apply to the Service Area, which shall be that area within the incorporated area <br />of the City of Casselberry, including those areas that are annexed into the City after the effective <br />date of this Ordinance, to finance capital facilities, the need for which is created by new <br />development, including: <br />(I) Police Services Impact Fees <br />(2) Fire Rescue Services Impact Fees <br /> <br />Section 55-5. Payment of Municipal Services Impact Fees. <br /> <br />(I) Any person who seeks to develop land within the City of Casselberry by applying for a <br />Building Permit is hereby required to pay a municipal services impact fee relating to police and <br />fire rescue services in the manner and amount set forth in the Schedule of Impact Fees <br />(Appendix A). The Municipal Services Impact Fee shall be paid concurrently with the receipt of <br />the Certificate of Occupancy, and shall be equal to the sum of the applicable police services and <br />fire rescue services impact fees. <br /> <br />(2) Payment of the Municipal Services Impact Fees established in this Ordinance in advance of <br />receiving the Certificate of Occupancy (prepayment) will not be accepted by the City of <br />Casselberry. <br /> <br />(3) No Certificate of Occupancy requiring payment ofa Municipal Services Impact Fee pursuant <br />to this article shall be issued unless and until the Municipal Services Impact Fee required has <br />been paid. <br /> <br />Section 55-6. Schedule of Impact Fees. <br /> <br />(I) Specified Uses. The municipal services impact fee relating to police and fire rescue services <br />shall be the sum of the applicable police services and fire rescue services impact fees for all <br />Certificate of Occupancy applications, using the Schedule of Impact Fees contained in Appendix <br />A. The Schedule of Impact Fees presents the annual fees collectable for each Fiscal Year from <br />Fiscal Year 2006 through 2015. All fees become effective on October I of each Fiscal Year <br />unless the City Commission repeals or amends this ordinance. <br /> <br />(2) Unspecified Uses. If the type of development activity that a Certificate of Occupancy is <br />applied for is not specified on the Schedule of Impact Fees (Appendix A), the City Manager or <br />designee shall determine the appropriate fee by considering documentation provided by the <br />applicant. <br /> <br />(3) Change in Use or Densitv. In the case of change in use, redevelopment, expansion or <br />modification of an existing use of a site which requires the issuance of a Certificate of <br />Occupancy, the Municipal Services Impact Fee shall be based upon the net increase in the <br />Municipal Services Impact Fee for the new use as compared to the most intense previous use on <br />or after February 27'\ 2006 (the Effective Date of this Ordinance).
