Commissioners Hufford and Doerner supported the ordinance. MOTION: Moved by Commissioner Linda Hart to continue Ordinance 06-1194 on second reading and refer back to the City Manager for further action. Motion was seconded by Commissioner Colleen S. Hufford and carried on a 5 - 0 vote. B. First Reading of Ordinance 06-1199 - Future Land Use Map Amendment to Designate Properties as Industrial Medium (LPA 06-14) Lots 3, 4,5,6 and 7 of the Northeast Industrial Park Replat The City Clerk read Ordinance 06-1199 by title as follows: "AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 66, SECTION 66-29 OF THE CITY OF CASSELBERRY CODE OF ORDINANCES, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN; AMENDING THE FUTURE LAND USE MAP DESIGNATION OF APPROXIMATELY FIVE (5) ACRES OF PROPERTY LYING BETWEEN BELLE A VENUE AND HELEN STREET, CONSTITUTING A SMALL SCALE AMENDMENT, FROM THE SEMINOLE COUNTY FLU OF "INDUSTRIAL" AND "MEDIUM DENSITY RESIDENTIAL" TO CITY I-M, "INDUSTRIAL-MEDIUM," TO INCLUDE ADULT ENTERTAINMENT LAND USES; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE." Lee:aI Advertisement: Advertised in the Orlando Sentinel on July 12,2006. The property was also posted and notice was provided by mail to property owners within 500 feet of the site. Ms. Sandra Smith, Acting Community Development Director read a statement into the record, which is attached to and made a part of these minutes. Staff Presentation: Ordinance 06-1199 is a Future Land Use Map Amendmentthat designates the Northeast Industrial Park Replat (Lots 3, 4, 5, 6 and 7) as Industrial Medium land use designation. This designation allows adult entertainment establishments and sexually oriented businesses as a permitted use. The properties proposed for the Industrial Medium (LP A 06-14) future land use are located outside the required 2,500 foot distance separation between adult entertainment establishments and schools mandated by Florida Statutes. The future land use map amendment is a small scale map amendment of less than ten (10) acres and does not require review by the Department of Community Affairs. The Planning and Zoning Commission reviewed this application on June 28, 2006 and provided a favorable recommendation to the City Commission. Staff Recommendation: Ordinance 06-1199 was unanimously approved on first reading on July 10,2006 by the City Commission. Recommend approval of Ordinance 06-1199 on second and final reading.
