First Reading of Ordinance 06-1199 - Future Land Use Map Amendment to Designate Properties <br />as Industrial Medium (LPA 06-14) Lots 3, 4,5,6 and 7 of the Northeast Industrial Park Replat <br /> <br />The City Clerk read Ordinance 06-1199 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AMENDING CHAPTER 66, SECTION 66-29 OF THE <br />CITY OF CASSELBERRY CODE OF ORDINANCES, SAID ORDINANCE BEING <br />THE COMPREHENSIVE PLAN; AMENDING THE FUTURE LAND USE MAP <br />DESIGNATION OF APPROXIMATELY FIVE (5) ACRES OF PROPERTY LYING <br />BETWEEN BELLE A VENUE AND HELEN STREET, CONSTITUTING A SMALL <br />SCALE AMENDMENT, FROM THE SEMINOLE COUNTY FLU OF <br />"INDUSTRIAL" AND "MEDIUM DENSITY RESIDENTIAL" TO CITY I-M, <br />"INDUSTRIAL-MEDIUM," TO INCLUDE ADULT ENTERTAINMENT LAND <br />USES; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE <br />DATE." <br /> <br />Lee:aI Advertisement: Advertised in the Orlando Sentinel on July 12,2006. The property was also posted <br />and notice was provided by mail to property owners within 500 feet of the site. <br /> <br />Ms. Sandra Smith, Acting Community Development Director read a statement into the record, which is <br />attached to and made a part of these minutes. <br /> <br />Staff Presentation: Ordinance 06-1199 is a Future Land Use Map Amendmentthat designates the Northeast <br />Industrial Park Replat (Lots 3, 4, 5, 6 and 7) as Industrial Medium land use designation. This designation <br />allows adult entertainment establishments and sexually oriented businesses as a permitted use. The <br />properties proposed for the Industrial Medium (LP A 06-14) future land use are located outside the required <br />2,500 foot distance separation between adult entertainment establishments and schools mandated by Florida <br />Statutes. The future land use map amendment is a small scale map amendment of less than ten (10) acres <br />and does not require review by the Department of Community Affairs. The Planning and Zoning <br />Commission reviewed this application on June 28, 2006 and provided a favorable recommendation to the <br />City Commission. <br /> <br />Staff Recommendation: Ordinance 06-1199 was unanimously approved on first reading on July 10,2006 <br />by the City Commission. Recommend approval of Ordinance 06-1199 on second and final reading. <br />
