<br />City Commission Meeting <br />July 10,2006 <br />Page 8 <br /> <br />churches, parks and residences and will require these type businesses to be located within the I-M Zoning <br />district. The Code is also amended to provide a nonconforming status to existing establishments that do not <br />meet the new zoning requirements and updated the "Findings" portion of the Code. The Planning and Zoning <br />Commission reviewed this application on June 28, 2006 and provided a favorable recommendation for the <br />first public hearing. <br /> <br />Staff Recommendation: Approval of Ordinance 06-1201and schedule the final public hearing for July 24, <br />2006. <br /> <br />Audience Input: Comments made under Citizen's Comments, no additional requests to speak. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to approve Ordinance 06-1201, <br />Amendments to Chapter 14 (LPA 06-13) as presented. Motion was seconded <br />by Commissioner Linda Hart and carried on a 5 - 0 vote. <br /> <br />E. First Reading of Ordinance 06-1202 Official Zoning Map Amendment to Designate Properties as <br />Industrial Medium (ZB 06-05) - Lots 3, 4, 5, 6 and 7 of the Northeast Industrial Park Replat <br /> <br />The City Clerk read Ordinance 06-1202 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />THE CITY OF CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN <br />ARTICLE IV, SECTION 2-4.3, UNIFIED LAND DEVELOPMENT REGULATIONS <br />OF THE CITY OF CASSELBERRY, FLORIDA, AS AMENDED AND <br />SUPPLEMENTED; ESTABLISHING THE ZONING CLASSIFICATION OF I-M, <br />INDUSTRIAL-MEDIUM, FOR APPROXIMATELY FIVE (5) ACRES OF <br />PROPERTY LYING BETWEEN BELLE AVENUE AND HELEN STREET, TO <br />INCLUDE ADULT ENTERTAINMENT LAND USES; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE." <br /> <br />Le!!al Advertisement: Advertised for first public hearing in the Orlando Sentinel on June 28, 2006. <br /> <br />Staff Presentation: Ordinance 06-1202 amends the Official Zoning Map to designate properties, Lots 3, 4, <br />5,6 and 7 of the Northeast Industrial Park Replat as I-M Zoning. The properties currently have a Seminole <br />County Zoning of C3. This designation allows adult entertainment establishments and sexually oriented <br />businesses as permitted use. The proposed properties for Industrial Medium future land use and I-M Zoning <br />are located outside the 2,500 foot distance separation from schools mandated by Florida Statutes. The <br />Planning and Zoning Commission reviewed this application on June 28, 2006 and provided a favorable <br />recommendation to the City Commission for the first public hearing. <br /> <br />Staff Recommendation: Approval of Ordinance 06-1202 with the insertion of "Plat Book 70, Pages 77 and <br />78 under the legal description in Section 1, page 2. <br /> <br />Audience Input: Comments made under Citizen's Comments, no additional requests to speak. <br />
