First Reading of Ordinance 06-1199 - Future Land Use Map Amendment to Designate Properties as <br />Industrial Medium (LPA 06-14) Lots 3, 4, 5, 6 and 7 of the Northeast Industrial Park Replat <br /> <br />The City Clerk read Ordinance 06-1199 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AMENDING CHAPTER 66, SECTION 66-29 OF THE <br />CITY OF CASSELBERRY CODE OF ORDINANCES, SAID ORDINANCE BEING <br />THE COMPREHENSIVE PLAN; AMENDING THE FUTURE LAND USE MAP <br />DESIGNATION OF APPROXIMA TEL Y FIVE (5) ACRES OF PROPERTY LYING <br />BETWEEN BELLE AVENUE AND HELEN STREET, CONSTITUTING A SMALL <br />SCALE AMENDMENT, FROM THE SEMINOLE COUNTY FLU OF <br />"INDUSTRIAL" AND "MEDIUM DENSITY RESIDENTIAL" TO CITY I-M, <br />"INDUSTRIAL-MEDIUM," TO INCLUDE ADULT ENTERTAINMENT LAND <br />USES; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE." <br /> <br />Le!!al Advertisement: Advertised for first public hearing in the Orlando Sentinel on June 28, 2006. Property <br />owners within 500 feet of the property were notified via mail of the public hearing. <br /> <br />Staff Presentation: Ordinance 06-1198 is a Future Land Use Amendment to designate properties located <br />south of the Belle A venue in the Northeast Industrial Park Replat (LP A 06-14) as Industrial Medium. These <br />properties were purchased and annexed by the City on June 27, 2005 for the realignment of Winter park Drive <br />between Seminola Boulevard and S.R. 434. The properties proposed for Industrial Medium future land use <br />and the I-M Zoning are located outside the required 2,500 foot distance separation from schools mandated by <br />Florida Statutes. The Planning and Zoning Commission review this application on June 28, 2006 and <br />provided a favorable recommendation to the City Commission for first public hearing. <br /> <br />Staff Recommendation: Approval of Ordinance 06-1199 with changes as follows: <br />. On page 2 of 4, Third Whereas Clause, delete the phrase "....at which it reviewed the written <br />comments submitted by the Department of Community Affairs in the Objections, <br />Recommendations and Comments Report.... " <br />. On page 3 of 4, Legal Description, insert plat book and page numbers, "....PLAT BOOK 70, <br />Pages 77 and 78...." <br />. Schedule final public hearing for July 24, 2006. <br /> <br />Audience Input: Comments made under Citizen's Comments, no additional requests to speak. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Susan Doerner to approve Ordinance 06-1199 with <br />change on page 2, deletion of phrase in third whereas clause and change on page <br />3, insertion of plat book and page numbers as recommended by staff. Motion <br />was seconded by Commissioner Colleen S. Hufford and carried on a 5 _ 0 vote. <br />
