Resolution 06-1681 - Lien Foreclosure Settlement Agreement with Chris Lee re Mallek Property, <br />380 Orange Lane <br /> <br />The City Clerk read Resolution 06-1681 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY,FLORIDA, AUTHORIZING <br />THE EXECUTION OF A SETTLEMENT AGREEMENT BETWEEN CHRIS LEE <br />AND THE CITY OF CASSELBERRY, REGARDING THE FORECLOSURE OF <br />TWO CODE ENFORCEMENT LIENS ON THE MALLEK PROPERTY, 380 <br />ORANGE LANE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br /> <br />Staff Presentation: The City Attorney stated that the City has Code Enforcement Liens against property at <br />380 Orange Lane totaling $72,200. The property is fairly valuable property and we have gotten a default <br />against the main defendant. The proposed purchaser, Mr. Chris Lee, has agreed to make certain <br />beautification and visual enhancements to the property, in accordance with the approved site plan. The <br />purchaser agrees to pay $15,000 in full and complete satisfaction of two Code Enforcement Liens, plus <br />$3,479 representing attorneys fees and costs. Mr. Lee has requested a change to paragraph 3 of the <br />agreement to grant an extension of the closing date on the property to October 14, 2006, instead ofJune 14, <br />2006. <br /> <br />Mr. Chris Lee, purchaser, was in the audience and available for questions. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Linda Hart to approve Resolution 06-1681, <br />Settlement Agreement between Chris Lee and the City, with amendment to <br />Paragraph 3, extending closing date to October 14, 2006. Motion was seconded <br />by Commissioner Colleen S. Hufford and carried on a 5 - 0 vote. <br /> <br />12.
