CASSELBERRY CITY COMMISSION Minutes of February 27, 2006 - Regular Meeting Page 3 of 13 3. Sandi Solomon, 6 Baybeny Branch, spoke in favor of Resolution 06-1651 and Resolution 06-1652. Ms. Solomon stated the Commission should be enthusiastic and not stall the projects since they will give the City a chance to progress and prosper. 4. John Casselbeny, 700 South Lost Lake Lane, stated that the Commission should have the ability to call for random polling on any vote in that it would alleviate pressure on any one Commissioner and the predictability of outcome of votes. 8. PUBLIC HEARINGS A. SECOND READING OF ORDINANCE 06-1179 - MUNICIPAL IMPACT FEE STUDY The City Clerk read Ordinance 06-1179 by title as follows: "AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, SEMINOLE COUNTY, FLORIDA AMENDING PART II, CITY CODE OF ORDINANCES, CREATING CHAPTER 55, MUNICIPAL SERVICE IMP ACT FEES, TO ESTABLISH MUNICIPAL SERVICES IMPACT FEES; PROVIDING FOR THE IMPOSITION OF MUNICIPAL SERVICE IMPACT FEES ON LAND DEVELOPED IN THE CITY OF CASSELBERRY FOR THE PROVISION OF MUNICIPAL SERVICES CAPITAL FACILITIES RELATED TO POLICE AND FIRE RESCUE SERVICES NECESSITATED BY NEW DEVELOPMENT; PROVIDING FOR SHORT TITLE; PROVIDING FOR SHORT TITLE; PROVIDING FOR FINDINGS, PURPOSE AND INTENT; PROVIDING FOR DEFINITIONS; PROVIDING FOR IMPLEMENTING REGULATIONS FOR MUNICIPAL SERVICES IMPACT FEES; PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS AND AN EFFECTIVE DATE." Legal Advertising: The notice of public hearing relative to Ordinance 06-1179 was published in the Orlando Sentinel on February 17,2006. Staff Presentation: Mr. Stampfler stated Ordinance 06-1179 provides for the imposition of municipal service impact fees on land developed in the City for the provision of municipal services capital facilities related to police and fire services necessitated by new development. A Municipal Impact Fee Study dated January 10, 2006 was conducted by Public Resources Management Group, Inc. Mr. Stampfler noted that members of Public Resources Management Group, Inc. were present and available for any inquiries of the City Commission. Staff recommended approval of Ordinance 06-1179 as presented. Public Hearing: No audience comment request forms were received for Ordinance 06-1179. Vice Mayor Hart closed the public hearing. MOTION: Commissioner Hufford moved to approve Ordinance 06-1179 on second and final reading as presented. Motion was seconded by Commissioner Doerner. Motion carried unanimously 4 - 0 by voice vote.
