Approval of Preliminary Plat SP 05-03, Enclave at Wyndham Woods, Seminola Boulevard and <br />Wyndham Way <br /> <br />Staff Presentation: SP 05-03 is the preliminary plat for the enclave a Wyndham Woods and is a proposed <br />town home subdivision located in the northeast quadrant of the Seminola Boulevard and Wyndham Way <br />intersection. The property is approximately 1.93 acres, previously contained three structures, each one with <br />a single family residence. The site has the appropriate infrastructure with regards to sewer and water. The <br />preliminary plat is in compliance with the Casselberry ULDR and the Planning and Zoning Commission <br />recommended approval of the plat on November 16,2005. <br /> <br />The City Attorney has reviewed the plat and title opinion and commented as follows: <br /> <br />. The title opinion should be a more comprehensive search such as a plat search or title search report. <br />Authorization proof of person signing on behalf of Semino1a Townhomes, LLC. <br />. Plat needs to be revised to add: "All platted utility easements shall provide that such easements <br />shall also be easements for the construction, installation and operation of cable television services." <br />A joinder and consent is required for the mortgage. <br />. Legal description on the title opinion should include the metes and bounds description. <br />. 2005 taxes are to be paid prior to final approval. <br /> <br />Staff Recommendation: Recommend approval of SP 05-03 based on the following conditions: <br /> <br />1) The City Attorney's comments are to be satisfied prior to final plat approval and issuance ofbuilding <br />permits. <br /> <br />2) The following conditions should be placed within the Homeowner Association Conditions, <br />Covenants and Restrictions document and noted on the approved site plan: <br /> <br />a) There shall be no parking allowed on the internal private roadway or grass areas. Signage <br />shall be posted within the development for enforcement. <br /> <br />b) There shall be no additional imporvements to the site, eithere by the developer, general <br />contractor, the homeowner association or the individual property owners that will increase <br />the impervious surface ration above the 50% maximum, as proposed by the applicant on the <br />approved site plan. <br /> <br />c) The proposed garages shall be maintained as a garage to meet the parking requirements of <br />the development and shall not be enclosed as living area or storage space. <br /> <br />3) Properties within the subdivision may not be sold until a final plat is approved and recorded by the <br />City. A performance bond or certificate of completion is required prior to submitatal for the final <br />plat review. The final plat shall be submitted to the City Commission in the format of (14) 11" x <br />17" copies and (4) 20" x 24" copies). The Homeowner's Association documents and By-Laws shall <br />also be approved by the City Attorney prior to final plat approval. <br />
