Regular Meeting <br />Page 10 of 13 <br /> <br />Staff Recommendation: Approve Resolution 06-1641, accepting settlementagreementof$112,272.50 with <br />J.M. Hattaway. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to <br />approve Resolution 06-1641, Hattaway Billboard <br />Settlement Agreement, as presented. The motion was <br />seconded by Commissioner Susan Doerner for <br />discussion. <br /> <br />Discussion: <br /> <br />Commissioner Doerner asked for a breakdown of the cost for each billboard. Mr. Stampfler stated that the <br />discussions were for $50,000 for each billboard and the additional $12,272.50 because one billboard was <br />actively in use and the settlement agreement was a excellent end to what could potentially cost the City in <br />litigation and the recommendation for approval of the agreement as an excellent resolve to rid the City of <br />these types of billboards for the aesthetics in the community. <br /> <br />Commissioner Cook asked what funding source was being used for the settlement and the cost for removal <br />of the billboards. Mr. Stampfler stated this would come from the Selflnsurallce Fund and the estimated cost <br />for removal ofthe billboards is $5,000. <br /> <br />Commissioner Hart asked what attorneys' fees had already beell expended. Mrs. Reischmann stated that <br />the only expenses by the City were her attorneys' fees which were not extensive. The Florida League had <br />takell over the defense which was at 110 expense to the City. <br /> <br />VOTE ON THE MOTION: The motion carried on a 5 - 0 vote. <br /> <br />1. Approval of Final Subdivision Replat SP 05-02, Centex Homes/Legacy Park, Residential <br />Phases 1 and 2 <br /> <br />Staff Presentation: Legacy Park is a planed development in the Seminola Boulevard Overlay District at the <br />eastern end of Seminola Boulevard. The property was originally cOllsolidated by Northland Church as <br />Legacy Park. The replat for Legacy Park is a 337 lot residential development owned and developed by <br />Centex Homes. The development includes 150 townhome units and 187 single family units. SP 05-02 is the <br />final replat for Legacy park residential subdivision. The final plat was reviewed and approved by the <br />Planning and Zoning Commission on October 12, 2005. The plat was also reviewed by the City Attorney <br />and City Surveyor. The developer has submitted a performance bond in amount of$5,233,011. <br /> <br />Staff Recommendation: Approval of the Legacy Park Plat that is dated November 2,2005 subject to the <br />following conditions: <br /> <br />1. The City Attorney's final review alld approval of the Homeowner Declaration of Covenants, <br />Conditions, and Restrictions for the master and residential communities be achieved. <br /> <br />2. The developer provide a title certificate issued after November 14, 2005, based on the City <br />Attorney's request. <br />
