<br />CASSELBERRY CITY COMMISSION <br />Minutes of January 9, 2006 . Regular Meeting <br />Page 9 of 13 <br /> <br />AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND CPH <br />ENGINEERS, INC. FOR ENGINEERING SERVICES ASSOCIATED WITH THE <br />CONSTRUCTION OF THE HUNTERFIELD ROAD STORAGE AND HIGH <br />SERVICE PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br /> <br />Staff Presentation: Resolution 06-] 640 approves Amendment No. 1 to Supplement No. 16 of the <br />Continuing Services Agreement for environmental engineering with CPH Engineers, which was approved <br />by the City Commission on Mach 14, 1994. The agreement was for the design of a 250,000 gallon ground <br />storage tank and high service pumping facility adjacent to the City's elevated storage tank on Hunterfield <br />Road in the Fern Park area. Amendment No. I to Supplement] 6 is in the amount of$32,562.00 to authorize <br />construction phase services for the project. Funds for this project are available in the Water and Sewer Non- <br />Departmental Professiollal Services account (401-190-536-3] .00). <br /> <br />Staff Recommendation: The Project is in compliance with Department of Environmental Protection (DEP) <br />Plans and Specifications and staff recommends approval of Resolution 06-1640. <br /> <br />Audience Input: Mr. John Casselberry, 700 S. Lost Lake Lalle, questioned the project and suggested that <br />further engineering research on the project. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Susan Doerner to approve <br />Resolution 06-1640, Supplement to CPH Engineers, <br />Inc., as presented. The motion was seconded by <br />Commissioner Colleen S. Hufford and carried <br />unanimously by voice vote. (5 - 0) <br /> <br />H, Resolution 06-1641 - Proposed Billboard Settlement Agreement Between City of Casselberry <br />and Hattaway Realty <br /> <br />The City Clerk read Resolution 06-1641 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />THE EXECUTION OF A SETTLEMENT AGREEMENT BETWEEN J. M. <br />HATTAWAY A.K.A.HATTAWAYREALTY AND THE CITY OF CASSELBERRY <br />REGARDING THE REMOVAL OF TWO BILLBOARDS, ONE LOCATED ON <br />STATE ROAD 434 AND A SECOND BILLBOARD LOCATED ON U.S. HIGHWAY <br />17/92; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE." <br /> <br />Staff Presentation: Resolution 06-164] approves a Settlement and Release Agreement between the City <br />of Casselberry and Mr. J.M. Hattaway. This Agreement resolves the lawsuit filed against the City by Mr. <br />Hattaway under the Bert Harris Act and provides for the removal of two billboards, one located Oil State <br />Road 434 and the other on U. S. Highway 17-92. The amount of the Settlemellt Agreement is $112,272.50. <br />
