Mail <br /> <br />Re: Continuing Geotechnical Engineering Consulting Services/Legal Opinion <br /> <br />Dear Mr. Segreto <br /> <br />As requested, I have researched whether the City of Casselberry may enter into more than one <br />continuing contract for professional engineering services under the Consultants Competitive <br />Negotiation Act (the "CCNA"). The CCNA sets forth requirements for the procurement and <br />contracting of professional engineering services by a city. The CCNA does not prohibit a city rrom <br />entering into more than one continuing contract for professional engineering services. <br /> <br />The Office of the Attorney General has opined that the CCNA does not provide criteria for <br />negotiating a contract for professional servi,ces under a continuing contract and that a city may <br />develop its own procedures for evaluating such a contract. In AGO 93-56, the City of Ormond <br />Beach had four continuing contracts for professional engineering services, Each contract had a <br />genera! fee structure describing the hourly fee per position and each provided that given projects <br />would be negotiated and defined in subsequent addenda. The City of Ormond Beach wanted to <br />obtain fee quotations fÌ'om the firms under continuing contract to select one firm to perform a given <br />project. In AGO 93-56, the Attorney General opined that nothing in the CCNA purports to regulate <br />the terms of a continuing contract or the ability of an agency to impose additional criteria on <br />continuing contractors to insure impartiality when a choice must be made among them. <br /> <br />In AGO 93-56, the Attorney General noted that the continuing contract arrangement should be <br />utilized sparingly in order to avoid the appearance of circumventing the requirements of the CCNA. <br />The Attorney General concluded <br /> <br />Therefore, if a municipality determines that it is appropriate to <br />develop criteria for determining which firm under continuing contract <br />
