<br />D. Implementation of a road fee structure to require future road impact <br />construction to contribute its fair share of the cost of required transportation capital <br />improvements and additions is an integral and vital element ofthe regulatory plan of growth <br />management incorporated in the comprehensive plan. <br /> <br />E. The projected capital improvements and additions to the major road system <br />of the City and the allocation of projected costs between those necessary to serve existing <br />development and those required to accommodate traffic to be generated by road impact <br />construction, as presented in the study entitled "Transportation Plan and Impact Fee <br />Update -- City of Casselberry, Florida," approved and adopted by the City Commission on <br />October 18, 1999, and such projections are found to be in conformity with the <br />comprehensive plan. <br /> <br />F. Transportation planning is an evolving process, and the capital improvements <br />and additions to the major road system identified upon the date of adoption of the <br />ordinance from which this Ordinance is derived constitute projections of growth patterns <br />and transportation improvements and additions based upon present knowledge and <br />judgment. Therefore, in recognition of changing growth patterns and the dynamic nature <br />of population growth, it is the intent of the City Commission that the identified <br />improvements and additions to the major road system be reviewed and adjusted <br />periodically to ensure that road impact fees are imposed equitably and lawfully and are <br />utilized effectively based upon actual and anticipated traffic conditions at the time of their <br />imposition. <br /> <br />G. The City has a statutory responsibility to provide and maintain the City road <br />system. All road impact construction occurring in the City has an impact upon the need for <br />future improvements and additions to the major road system. Placing a fair share of the <br />burden of the cost of providing improvements and additions to the major road system <br />required by growth on road impact construction constitutes a City purpose. In recognition <br />ofthese findings, it is the intent ofthe City Commission to impose the Citywide road impact <br />fee on all road impact construction occurring within the City, and to utilize the proceeds of <br />such Citywide road impact fees to construct or acquire the contemplated improvements to <br />the major road system. <br /> <br />H. The purpose of this Ordinance is to require payment of Citywide impact fees <br />by road impact construction and to provide for the cost of capital improvements to the <br />major road system which are required to accommodate the additional traffic demand <br />caused by such road impact construction. This Ordinance shall not be construed to permit <br />the collection of impact fees from road impact construction in excess of the amount <br />reasonably anticipated to offset the demand on the major road system generated by such <br />road impact construction. <br /> <br />Page 2 of 27 <br />
