<br />ORDINANCE NO. 99-969 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />PROVIDING FOR THE IMPOSITION OF ROAD IMPACT FEES; <br />PROVIDING FOR SHORT TITLE; PROVIDING FINDINGS OF FACT, <br />INTENT AND PURPOSE; PROVIDING DEFINITIONS; PROVIDING RULES <br />OF CONSTRUCTION; ADOPTING AN IMPACT FEE STUDY; PROVIDING <br />FOR THE IMPOSITION OF IMPACT FEES AND SCHEDULES; <br />PROVIDING FOR ALTERNATIVE IMPACT FEE CALCULATION; <br />PROVIDING A PROCEDURE FOR REVIEW OF ALTERNATIVE IMPACT <br />FEE CALCULATIONS; PROVIDING FOR CREDITS, IF ANY; PROVIDING <br />FOR DETERMINATION OF VESTED RIGHTS; PROVIDING FOR THE USE <br />OF FUNDS COLLECTED AND REFUNDS; PROVIDING EXEMPTIONS; <br />PROVIDING FOR ANNUAL REVIEW; PROVIDING FOR CODIFICATION; <br />PROVIDING FOR SEVERABILITY PROVIDING FOR CONFLICTS AND <br />PROVIDING FOR AN EFFECTIVE DATE AND PHASING SCHEDULE. <br /> <br />SECTION I. That Chapter 67 of the Code of Ordinance of the City of Casselberry, <br />Florida shall be amended to read as follows: <br /> <br />ARTICLE I. IN GENERAL <br /> <br />Section 67-1. Short Title. This Chapter shall be known and may be cited as the <br />"Casselberry Road Impact Fee Ordinance". <br /> <br />Section 67-2. Findings of Fact, Purpose and Intent of Ordinance. It is hereby <br />ascertained, determined and declared that: <br /> <br />A. Both existing development and development necessitated by the growth <br />contemplated in the comprehensive plan will require improvements and additions to the <br />major road system of the City to accommodate and maintain traffic at the adopted level of <br />service standards. <br /> <br />B. Future growth represented by road impact construction should contribute its <br />fair share of the cost of improvements and additions to the major road system required to <br />accommodate traffic generated by such growth as adopted in the comprehensive plan. <br /> <br />C. The required improvements and additions to the major road system of the <br />City to accommodate existing traffic at adopted service standards, and to finance that <br />portion of the cost of improvements and additions required to accommodate future growth <br />not contemplated to be financed by impact fees, may be funded by revenue sources of the <br />City other than road impact fees. <br />
