<br />SECTION 4. Subsection (B) (1) of section 93.08 is <br /> <br />hereby amended to read as follows: <br /> <br />(B) Refuse containers are required as follows: <br /> <br />(1) Residential solid waste containers. Each <br />resident is required to furnish garbage con- <br />tainers which are adequate to hold all solid <br />waste. Solid waste containers shall be any <br />commonly available light gauge steel, plastic <br />or galvanized receptacle of a non-absorbent <br />material, closed at one end and open at the <br />other, furnished with a closely fitted lid or <br />top and handle(s) or waterproof plastic bags <br />of heavy mill construction which can be safely <br />and securely closed. A receptacle including <br />waste materials shall not exceed thirty two <br />(32) gallons in capacity nor fifty (50) pounds <br />in weight. No oil drums will be used. The <br />owner of rental property shall be responsible <br />for furnishing adequate containers for the <br />property. <br /> <br />SECTION 5. A new subsection (C) to Section 93.08 of <br /> <br />the Code of Ordinances is hereby created to read as follows: <br /> <br />(C) The city or its Franchisee shall provide recycling <br />containers for holding recyclable materials at curb- <br />side. Only recyclable materials shall be stored in <br />these recycling containers until collected in <br />accordance with this Chapter. To be eligible for <br />pick-up, Recyclable Materials must be put in the <br />recycling container. Newspapers shall be put in a <br />Kraft paper bag or be securely tied in a bundle and <br />placed on top of or next to the recycling container. <br /> <br />SECTION 6. A new Section 93.12 is hereby created to <br /> <br />read as follows: <br /> <br />PROHIBITED ACTS <br /> <br />S 93.12 <br /> <br />Except as provided in this Ordinance, it <br />shall be unlawful and a violation of this code <br /> <br />5 <br />
