NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA: SECTION 1. The City commission of the City of Cassel- berry has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the state of Florida and Chapters 166, 180 and 403, Florida statutes. SECTION 2. section 93.05 of the Code of Ordinances is hereby amended to read as follows: S 93.05 Collection (A) The city shall collect, or cause to be collected through issuance of a negotiated franchise, ð"d dis~ese-e£ all solid waste and recvclable materials ~ðr~ð~e at regular intervals to be determined by the city. All solid waste ~ðr~e~e in the business section of the city shall be collected and disposed of daily, and the owner or operator of each business establishment shall be required to pay the expenses of collecting and disposing of that ~ðr~ð~e solid waste. All residents, occupants or owners of residential premises in the City shall be required to have accu- mulations of solid waste and recyclable materials removed and disposed of by the city or its franchised agent, and for such service, or the availability of such service of solid waste and recyclables removal and disposal, shall pay the city the fees set by resolution. (B) The City shall by resolution set collection rates, and may establish security deposits for all cus- tomers served under the terms and conditions of the franchise agreement. These rates shall be reviewed periodically and shall be adjusted based on avail- able data such as, current cost paid to contractor for services, administrative cost incurred by the city and any cost associated with compliance with state, county, or federal environmental regulations. This resolution will be known as the "Solid Waste Rate" Resolution. 2
