(6.) The definition for Trash of Section 2, Definitions and Interpretations, is amended to read as'f6llows: Trash shall mean all refuse, accumulation of paper, rags, wooden or paper boxes and containers, sweepings, broken toys, tools, utensils, and all other accumulations of a similar nalure other than Garbage, which are usual to housekeeping, but shall not include Vegetative Waste. 7. The paragraph entitled, Rapid Recovery from Disaster, of Section 4, Services to be Provided, is amended to read as follows: Rapid Recovery from Disaster. The clean-up from some natural disasters may require that the Contractor hire additional equipment employ additional personnel, or work existing personnel on overtime hours to clean debris resulting from the natural disaster. The Contractor shall receive extra compensation above the normal compensation contained in this Agreement to recover the costs of rental equipment additional personnel, overtime hours, and other documented expenses provided the Contractor has secured written authorization and approval from the Contract Manager prior to the work being performed. The City prior to payment may audit all such costs. The City shall reimburse the contractor said fee after reimbursement from Federal Emergency Management Agency (FEMA), if such reimbursement is applicable to the emergencv of nature disaster. In the event of a declared natural disaster. Contractor shall not be required to pickup and remove anv limbs. trees. bulkv items or other debris which is created as a result. Contractor and. Citv shall use their mutual best efforts to effectuate an agreement if Contractor is selected to serve the Citv for such pickup and removal. Contractor shall not commence anv such pickup and removal prior to receiving a request bv the Citv Manager or Citv Manager's designated representative. Citv shall first negotiate with Contractor for this pickup. but Citv shall be free to contract with a responsible third partv for this service. Anv such contract between the City and a third vartv shall be limited to storm or other disaster removal and in that event shall no wav change. amend or affect anv of the other tenns of this Agreement. 8. Section 5, Service Changes for Public Welfare, is amended to read as follows: Section 5. Service Changes for Public Welfare The City shall have the authority to make changes in or to impose new and reasonable rules and regulations on the Contractor under this Agreement relative to the method of collection and disposal of Garbage, Trash, Bulk Trash, Vegetative Waste or Recyclable Materials as shall from time to time 3
