<br />(6.) The definition for Trash of Section 2, Definitions and Interpretations, is amended to <br />read as'f6llows: <br /> <br />Trash shall mean all refuse, accumulation of paper, rags, wooden or paper <br />boxes and containers, sweepings, broken toys, tools, utensils, and all other <br />accumulations of a similar nalure other than Garbage, which are usual to <br />housekeeping, but shall not include Vegetative Waste. <br /> <br />7. The paragraph entitled, Rapid Recovery from Disaster, of Section 4, Services to be <br />Provided, is amended to read as follows: <br /> <br />Rapid Recovery from Disaster. The clean-up from some natural disasters <br />may require that the Contractor hire additional equipment employ additional <br />personnel, or work existing personnel on overtime hours to clean debris <br />resulting from the natural disaster. The Contractor shall receive extra <br />compensation above the normal compensation contained in this Agreement to <br />recover the costs of rental equipment additional personnel, overtime hours, <br />and other documented expenses provided the Contractor has secured written <br />authorization and approval from the Contract Manager prior to the work <br />being performed. The City prior to payment may audit all such costs. The City <br />shall reimburse the contractor said fee after reimbursement from Federal <br />Emergency Management Agency (FEMA), if such reimbursement is applicable <br />to the emergencv of nature disaster. In the event of a declared natural <br />disaster. Contractor shall not be required to pickup and remove anv limbs. <br />trees. bulkv items or other debris which is created as a result. Contractor and. <br />Citv shall use their mutual best efforts to effectuate an agreement if <br />Contractor is selected to serve the Citv for such pickup and removal. <br />Contractor shall not commence anv such pickup and removal prior to <br />receiving a request bv the Citv Manager or Citv Manager's designated <br />representative. Citv shall first negotiate with Contractor for this pickup. but <br />Citv shall be free to contract with a responsible third partv for this service. <br />Anv such contract between the City and a third vartv shall be limited to storm <br />or other disaster removal and in that event shall no wav change. amend or <br />affect anv of the other tenns of this Agreement. <br /> <br />8. Section 5, Service Changes for Public Welfare, is amended to read as follows: <br /> <br />Section 5. Service Changes for Public Welfare <br /> <br />The City shall have the authority to make changes in or to impose new and <br />reasonable rules and regulations on the Contractor under this Agreement <br />relative to the method of collection and disposal of Garbage, Trash, Bulk <br />Trash, Vegetative Waste or Recyclable Materials as shall from time to time <br /> <br />3 <br />
