<br />CASSELBERRY CITY COMMISSION <br />Minutes of May 9, 2005 - Regular Meeting <br />Page 7 of 12 <br /> <br />is zoned PMX-L and has a corresponding Low-Intensity Non-ResidentiallMedium Density Residential future <br />land use designation. The Legacy Park Conceptual Plan was approved by the City Commission on December <br />8, 2003. The Planning & Zoning CommissionlLand Planning Agency recommended approval ofSPR 03-13 <br />and SP 03-05 by a unanimous vote at their February 23, 2005 meeting, subject to conditions outlined in the <br />minutes of said meeting. Staff recommended approval ofSPR 03-13 and SP 03-05, subject to conditions <br />outlined in Mr. Wells' April 29, 2005 inter-office memorandum to Mr. Clifton, which is attached to and <br />made a part of these minutes. <br /> <br />Audience Participation: One (1) audience comment request form was received for this item. The following <br />individual came forward: <br /> <br />1) John Casselberry, 700 South Lost Lake Lane, voiced concerns regarding drainage issues <br />associated with the subject development and road improvements. Mr. Casselberry also <br />voiced concerns regarding document signature verification and out of state corporation <br />issues. <br /> <br />The following representative for the applicant came forward: <br /> <br />2) Tom Daly, Daly Design Group, 913 North Pennsylvania A venue, Winter Park, stated the <br />applicant did not have any concerns regarding document signature verification. Mr. Daly <br />requested favorable action on SPR 03-13 and SP 03-05. <br /> <br />MOTION: <br /> <br />Vice Mayor Hart moved to approve SPR 03-13 and SP <br />03-05, Centex Homes/legacy Park Site Plan and <br />Preliminary Plat. Motion was seconded by <br />Commissioner Doerner. Motiou carried unanimously <br />by voice vote. <br /> <br />E. DISCUSSION & CONSIDERATION - PURCHASE/RESALE OF TWO-ACRE <br />PARCEL ON U.S. HIGHWAY 17-92 <br /> <br />Staff Presentation: Mr. Segreto requested the City Commission consider purchase and resale ofthe 2.2 acre <br />parcel located on U.S. Highway 17-92 north of the Police Station and with lakefront on Lake Concord. Mr. <br />Segreto gave an overview of the issues associated with the parcel including the potential re-establishment <br />of an adult entertainment business at the former Cabaret site on the subject property, as outlined in Mr. <br />Clifton's May 2, 2005 inter-office memorandum to the City Commission. Said inter-office memorandum <br />is attached to and made a part ofthese minutes. <br /> <br />Audience Participation: One (1) audience comment request form was received for this item. The following <br />individual came forward: <br /> <br />1) John Casselberry, 700 South Lost Lake Lane, spoke in opposition to the purchase and <br />resale of the subject parcel. <br />
