Ordinance 04-1151: Commercial vehicle parking
January 13, 2005
Page 3

4. Screenina of advertisina: Currently, Code Enforcement has allowed the use of blank magnetic signs to
cover the copy area on vehicles. This opportunity is not provided in the code. If commercial advertising
restrictions are adopted, code language is provided that can be added to the draft ordinance to allow an
opportunity to screen advertising. Vehicle covers and tarps are also commonly used to screen
commercial vehicles.

C. Improved parking area: Some of the Commissioners indicated a concern regarding vehicle parking in the
front yard; personal as well as commercial vehicles. A portion of Section 3-10.9 requires parking of vehicles "in
aàriveway or permanent designated area attached to the driveway.' No desian criteria are orovided, therefore it
IS a difficult provision to enforce. This section of the code can be revised to provide design criteria for a
stabilized surface. These criteria could include the following:
1. Type of material:
a Concrete, asphalt paving (impervious)
b. Pavers, brick (impervious)
c. Crushed rock, gravel, geo-web with gravel or sod (pervious)
d. As approved by the City Engineer
2. Minimum size: 8' X 16'
3. Setback from the property line: 5' (per Altamonte's RV parking requirement). This eliminates
encroachment into the sidewalk or right of way.

D. Personal vehicle size limitations; The current adopted code includes a restriction on the size and length of
personal vehicles. Due to the larger size of contemporary personal use vehicles, this portion of the code may be
inappropriate now. The draft ordinance has deleted this portion of the code.

E. Multifamily enforcement: The ULDR requires new multi-family development to provide parking spaces for
recreational vehicles. This portion of the Code could be expanded to allow commercial vehicle parking in this
designated area. If the development eliminates this parking area, the developments restrictive covenants should
include a statement prohibiting the parking of such vehicles within the development. The code could be written to
require the management company or homeowner's association to enforce the requirements on the common area.

F. Appeal process: A section has been created in the ordinance that allows an appeal to the Board of
Adjustment for an exception to the requirements for all vehicle types, including commercial, recreabonal, and
camping vehicles.

This information is provided for informational purposes. The City Attorney has not reviewed the draft language.

Attachments: Exhibit A: City Commission staff report dated November 22, 2004
Exhibit B: City Commission minutes dated November 22, 2004
Exhibit C: Staff revision of Ordinance 05---- [Section 3-10.9, Parking of vehicles in residential
districts (Current code language which includes text not yet codified plus options)]
Exhibit D: Photographs
Exhibit E: Jurisdictional standards comparison
Exhibit F: Vehicle Weight terminology

www.casselberry.org
