Wells, AICP, Community Development Diref~ <br /> <br /> <br />November 10, 2004 <br /> <br />TO: <br /> <br />DATE: <br /> <br />RE: <br /> <br />Ordinance No. 04·1151: Unified Land Development Code (ULDR) revision to Section 3·10.9, <br />Parking of vehicles in residential districts. (LPA 04-13) <br /> <br />The City Commission requested the Pianning and Zoning Commission to review the code as it relates to <br />parking commercial vehicles in residential areas and forwarded proposed revisions for consideration by the Planning <br />and Zoning Commission. The proposed revisions specifically address the Unified Land OeveloDment Requlations, <br />Part III, Article X, Section 3·10.9, Parking of vehicles in residential districts, as follows: <br /> <br />1. Subsection a(1) was rewritten to state that vehicles equal to or grealer than 6,000 pounds gross weight <br />or that are equal to or greater than 20 feet in length may only be parked in residential areas when <br />actively engaged in temporary or service work. <br />2. Subsection b(3) was rewritten to allow unrestricted commercial advertising commercial vehicles that <br />would otherwise be allowed to park in residential districts. <br />3. Subsection c was added to state that commercial vehicles may not park on the city rights-of-way unless <br />actively engaged in temporary service work at the nearby residence. <br /> <br />A workshop was conducted during the October 13, 2004 Planning and Zoning Commission, and topics. <br />discussed included the potential and perceived impacts to the neighborhoods, code requirements of other local <br />jurisdictions, and the language of the proposed ordinance. The Planning and Zoning Commission requested <br />additional information from staff for lhe October 27, 2004 meeting. Notice of the October 27, 2004 public hearing was <br />. provided in the Oriando Sentinei on October 17, 2004. <br /> <br />Allhe October 27, 2004 meeting, the Pianning and Zoning Commission reviewed the photographs provided, <br />discussed the size of vehicles, the types of vehicles and the accessory equipment (ladders, lifts, winches), and the <br />negative impacls to neighborhoods. The Commission also discussed other subsections within the code regarding <br />designated parking areas in the front yard and parking of recreational vehicles. After considerable discussion the <br />Commission accepted public input and then made a motion that was unanimously approved. The Planning and <br />Zoning Commission recommendalion to the City Commission is to not adopt the proposed ordinance based on the <br />following motion: <br /> <br />'The Planning and Zoning Commission will not reduce the current standards, and if <br />commercial vehicle parkilìg is addressed, it has to be addressed as a complete package and <br />take into account any and all vehicles parked in residential areas and the enforcement of all <br />those codes and the Planning and Zoning Commission is willing to take on that task." <br /> <br />3. <br />
