PUBLIC HEARING AND SECOND READING OF ORDINANCE 04-1148 - LP A <br />04-01 - FUTURE LAND USE MAP AMENDMENT - BOTTOM OF LAKE <br />HOWELL <br /> <br />The City Clerk read Ordinance 04-1148 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE <br />CITY OF CASSELBERRY COMPREHENSWEPLAN,BY AMENDING THE OFFICIAL <br />FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION <br />OF RECREATION OPEN SPACE (ROS) FOR THAT PARCEL DESCRIBED IN <br />SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND AN EFFECTWE DATE." <br /> <br />Legal Advertising: The Notice of Public Hearing relative to Ordinance 04-1148 was published in the <br />Orlando Sentinel on December 26, 2004. <br /> <br />Staff Presentation: Mr. Wells stated Ordinance 04-1148 administratively amends the Future Land Use <br />classification of the subject property from County Conservation to City Recreation Open Space. The subject <br />property was purchased by the City and annexed into the City in January 2004 to provide possible mitigation <br />acreage for future City projects that may impact wetland areas and possible contiguity for future annexation <br />initiatives. The parcel consists of approximately 70 acres of Lake Howell and associated wetlands. The <br />request is being processed as a Large Scale Map amendment in accordance with Florida Statutes. The <br />Planning & Zoning Commission recommended approval of Ordinance 04-1148 at its July 28,2004 meeting <br />by a 5 - I vote. The City Commission approved Ordinance 04-1148 on first reading on August 23, 2004. <br />Ordinance 04-1148 was transmitted to the Florida Department of Community Affairs (DCA) forreview and <br />approval. DCA approved Ordinance 04-1144 with the request the amendment be revised to include the <br />City's Conservation Overlay as a specific part ofthe FLUM designation ofthe property. Staff recommended <br />approval of Ordinance 04-1148 with the inclusion of DCA's request. <br /> <br />Public Hearing: One audience comment request form was received for Ordinance 04-1148. The following <br />individual came forward: <br /> <br />1) John Casselberry, 700 South Lost Lake Lane, voiced concerns regarding the title search <br />conducted for the subject property when it was purchased by the City, and requested to <br />review a copy of the title search. <br /> <br />No one else came forward. Mayor Goff closed the public hearing. <br /> <br />MOTION: <br /> <br />Vice Mayor Hart moved to approve Ordinance 04-1148 <br />on second and final reading. Motion was seconded by <br />Commissioner Hufford. Motion carried nnanimously <br />by voice vote. <br />
