PUBLIC HEARING AND SECOND READING OF ORDINANCE 04-1148 - LP A 04-01 - FUTURE LAND USE MAP AMENDMENT - BOTTOM OF LAKE HOWELL The City Clerk read Ordinance 04-1148 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSWEPLAN,BY AMENDING THE OFFICIAL FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION OF RECREATION OPEN SPACE (ROS) FOR THAT PARCEL DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTWE DATE." Legal Advertising: The Notice of Public Hearing relative to Ordinance 04-1148 was published in the Orlando Sentinel on December 26, 2004. Staff Presentation: Mr. Wells stated Ordinance 04-1148 administratively amends the Future Land Use classification of the subject property from County Conservation to City Recreation Open Space. The subject property was purchased by the City and annexed into the City in January 2004 to provide possible mitigation acreage for future City projects that may impact wetland areas and possible contiguity for future annexation initiatives. The parcel consists of approximately 70 acres of Lake Howell and associated wetlands. The request is being processed as a Large Scale Map amendment in accordance with Florida Statutes. The Planning & Zoning Commission recommended approval of Ordinance 04-1148 at its July 28,2004 meeting by a 5 - I vote. The City Commission approved Ordinance 04-1148 on first reading on August 23, 2004. Ordinance 04-1148 was transmitted to the Florida Department of Community Affairs (DCA) forreview and approval. DCA approved Ordinance 04-1144 with the request the amendment be revised to include the City's Conservation Overlay as a specific part ofthe FLUM designation ofthe property. Staff recommended approval of Ordinance 04-1148 with the inclusion of DCA's request. Public Hearing: One audience comment request form was received for Ordinance 04-1148. The following individual came forward: 1) John Casselberry, 700 South Lost Lake Lane, voiced concerns regarding the title search conducted for the subject property when it was purchased by the City, and requested to review a copy of the title search. No one else came forward. Mayor Goff closed the public hearing. MOTION: Vice Mayor Hart moved to approve Ordinance 04-1148 on second and final reading. Motion was seconded by Commissioner Hufford. Motion carried nnanimously by voice vote.
