APPROVAL OF LAKE MARIE SHORES FINAL REPLAT ŒKA SPRUNG'S <br />REPLAT) <br /> <br />Staff Presentation: Mr. Wells stated the proposed lots of Lake Marie Shores (formerly known as Sprung's <br />Replat) are located on the north side of Quintuplet Drive,just west of Lake Drive and extend from Quintuplet <br />Drive to the shoreline of Lake Marie. The replat includes two lots from a previously platted subdivision <br />(Sportsman's Paradise). The properties are being replatted to accommodate the encroachment of a structure <br />at 1331 Quintuplet Drive on the property at 1327 Quintuplet Drive. The preliminary plat was approved <br />unanimously by the Planning & Zoning Commission at its October 8,2003 meeting. The City Attorney has <br />reviewed and approved the final plat and title opinion. The City Surveyor has also reviewed and approved <br />the plat in accordance with Chapter 177 of the Florida Statutes. Staff recommended approval of the final <br />replat of Lake Marie Shores subject to the following conditions: <br /> <br />I. The applicant, per Chapter 177 of the Florida Statutes, shall submit a check made payable <br />to the City of Casselberry in the amount of $595.00 to cover the City Surveyor's fees. <br />2. Upon approval by the City Commission, the applicant shall provide City staff with a check <br />made payable to the Clerk of the Circuit Court in the amount of$87.99 for recording fees <br />ofthe executed mylars, and another information required as part of compliance with Chapter <br />177 of the Florida Statutes. <br />3. That the proper banks sign the joinder and consent with the City Attorney approval prior to <br />recording of the associated documents. <br /> <br />MOTION: <br /> <br />Commissioner Hufford moved to approve SP 03-09, <br />Lake Marie Shores Final Replat (formerly known as <br />Sprung's Replat), 1327 & 1331 Quintuplet Drive, <br />subject to the three conditions outlined in these <br />minutes. Motion was seconded by Commissioner <br />Doerner. Motion carried unanimously by voice vote. <br /> <br />F. DISCUSSION - BOARD OF ADJUSTMENT APPEALS PROCESS <br /> <br />Staff Presentation: Mr. Clifton stated Mayor Goff had requested that the matter be placed on the agenda <br />for discussion and gave a brief presentation regarding the appeals procedures for the Board of Adjustment <br />as outlined in his December 15, 2004 inter-office memorandum to the City Commission, which is attached <br />to and made a part ofthese minutes. Mrs. Reischmann stated if the City Commission decides to allow <br />appeal of Board of Adjustment decisions to the City Commission, the Commission will then have to decide <br />whether to make that appeal should be de novo or a certiorari review. <br />
