<br />CASSELBERRY CITY COMMISSION <br />Minutes of June 28, 2004 - Regular Meeting <br />Page 9 of 12 <br /> <br />OF RELIGION AND SPEECH; AMENDING HOURS OF SOLICITATION TO COMPLY <br />WITH FEDERAL LAW; REQUIRING THAT PEDDLERS AND SOLICITORS OBTAIN <br />OCCUPATIONAL LICENSES IN THE CITY OF CASSELBERRY AND HOME <br />SOLICITATION SALES PERMITS AS REQUIRED BY FLORIDA LAW; CLARIFYING <br />THAT BUSINESSES SHALL BE RESPONSIBLE FOR INSURING THAT ITS AGENTS <br />HAVE VALID SOLICITOR'S PERMITS AND PROPER IDENTIFICATION WHEN <br />SOLICITING; CHANGING TIME FOR EXPIRATION OF SOLICITOR'S PERMITS TO <br />A MAXIMUM OF SIXTY (60) DAYS; PROVIDING FOR CHANGES IN APPLICATION <br />AND PERMITTING FEES AND FOR RENEWAL AND NON-TRANSFERABILITY OF <br />PERMITS; CLARIFYING WHEN A SOLICITOR'S PERMIT CAN BE REVOKED OR <br />DENIED; PROVIDING FOR NOTICE AND HEARING WHEN A SOLICITOR'S <br />PERMIT IS REVOKED AND PROVIDING FOR APPEAL WHEN APERMITIS DENIED <br />OR REVOKED; PROHIBITING SOLICITATION BY JUVENILES UNLESS A PERMIT <br />IS SOUGHT AND OBTAINED BY A RESPONSIBLE SPONSOR; PROVIDING FOR <br />PENAL TIES; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND <br />AN EFFECTIVE DATE." <br /> <br />Staff Presentation: Mr. Wells stated Ordinance 04-1129 provides for revisions and clarifications to the <br />City's peddler and solicitor regulations to align with recent case law. Mr. Wells stated the City typically only <br />receives six or less requests for solicitor/peddler permits annually. Staff recommended approval of <br />Ordinance 04-1129 on first reading. <br /> <br />Commission Discussion: Mayor Pronovost requested that page 4, section 26-68 be modified to reflect "as <br />defmed by the Internal Revenue Service Code". Vice Mayor Clark requested the City Attorney research the <br />age and time requirements for juvenile solicitors. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to approve Ordinance 04- <br />1129 on first reading as modified. Motion was <br />seconded by Commissioner Doerner. Motion passed 5 - O. <br /> <br />Public Hearing Date: The public hearing for Ordinance 04-1 129 is scheduled for Monday, July 26, 2004. <br />
