The Florida League of Cities will support legislation <br />that: <br /> <br />Requires that disabilities claimed as job- <br />related, such as hypertension, heart disease <br />or cancer, be proven by the weight of evidence <br />rather than by a statutory presumption. <br /> <br />Limits hypertension or heart disease <br />disability presumptions when a claimant <br />engages in lifestyle choices (including, but <br />not limited to, smoking, alcohol use or use <br />of controlled substances) that are <br />scientifically shown to lead to hypertension <br />or heart disease, or when a claimant is <br />otherwise predisposed to these conditions. <br /> <br />Requires any individual who may claim a <br />disability presumption be subject to <br />minimum h'ealth and physical fitness <br />standards and periodic examinations. <br /> <br />Personnel Expenditures <br /> <br />700 <br /> <br />Municipalities are maior employers in Florida. <br />Personnel-related expenses frequently account for <br />a maiority of municipal budget expenditures. <br />Municipal officials are held directly accountable <br />to their citizens for fiscal and administrative <br />personnel decisions and should, therefore, have <br />final control over the cost of providing pay and <br />benefits for their employees. <br /> <br />The Florida League of Cities will support legislation that: <br /> <br />700. <br /> <br />Protects the Home Rule authority of every city to <br />effectively and locally manage all aspects of <br />employee salary and benefit packages in a manner <br />that is in the best interest of taxpayers as well as <br />employees. <br /> <br />.2 Requires that disabilities claimed as job-related, <br /> such as hypertension, heart disease or cancer, be <br /> <br />proven by the weight of evidence rather than by a <br />statutory presumption. <br /> <br />700.3 <br /> <br />Permits state funds shared with municipalities, <br />which may include monies generated under <br />firefighter or police pension plans, to be used to <br />fund periodic health and physical fitness <br />examinations for local firefighters or law <br />enforcement officers, <br /> <br />700.4 <br /> <br />Clairifies the term "extra benefits" as used in <br />Chapters 175 and 185, Florida Statutes, to include <br />benefits provided prior to the effective date of <br />Chapter 99- i, Laws of Florida, (March 12, 1999). <br /> <br />Employer/Employee Relations <br /> <br />701 <br /> <br />Alternatives to collective bargaining, such as <br />strikes, binding arbitration and using the "end run" <br />of the state Legislature to obtain pay or benefits, <br />are unacceptable to locally elected officials. The <br />interjection of a third party into the process of <br />setting community priorities and levying taxes is <br /> <br />24 <br /> <br /> <br />
