308.3 <br /> <br />Ensures the authority of municipalities to provide <br />utility services including but not limited to the <br />following: electric, gas, sewer, water, and <br />stormwater now and into the future. <br /> <br />308.4 <br /> <br />Ensures the ability of municipalities and munici- <br />pal utilities to provide a full range of services and <br />products for customers without subjecting such <br />activities to taxation or undue regulation. <br /> <br />308.5 <br /> <br />Recognizes municipal authority to impose <br />reasonable, nondiscriminatory requirements for <br />the provision of communications services within <br />the municipality, so long as such requirements do <br />not conflict with the current jurisdiction of the <br />Public Service Commission. <br /> <br />308.6 Protects the stranded investments of municipalities. <br /> <br />308.7 <br /> <br />Protects municipalities from reductions of assessed <br />value of utility property, in-lieu payments or other <br />revenues, as a result of electric restructuring. <br /> <br />308.8 <br /> <br />Protects municipal authority to provide utility <br />services outside incorporated boundaries and to <br />charge a reasonable surcharge for these (non- <br />electric) services. <br /> <br />308.9 <br /> <br />Allows municipalities to become aggregators of <br />services, whether individually or on a collective <br />basis. <br /> <br />308.10 <br /> <br />Maintains municipal authority to set rates and <br />establish service for water, sewer, electric, gas, <br />telecommunications or any other municipally <br />operated utility. <br /> <br />308.11 <br /> <br />Authorizes municipalities to set utility service <br />rates without having to meet unreasonable notice <br />requirements or incur additional costs. <br /> <br />308.12 Respects the privacy of customers by exempting <br /> from public records information related to local <br /> government utility customers' accounts, unless <br /> expressly authorized by the customer. <br /> <br />3.13 <br /> <br />Ensures municipal competitiveness in providing or <br />arranging for utility services by exemptin§ from <br />the Public Records Law related business records. <br /> <br />308.14 Treats public records requirements of municipal <br /> communications enterprises equivalent to that of <br /> private communications operations. <br /> <br />308.15 Recognizes certain public records pertaining to <br /> utility compliance audit work papers should be <br /> exempt under the Public Records Law. <br /> <br />308, 16 Assists municipalities with developing technology <br /> infrastructure to enhance municipalities' and citi- <br /> zens' ability to become technologically connected. <br /> <br />308.17 Maintains local government authority to regulate <br /> the placement of a utility provider's facilities within <br /> the local government's jurisdiction, and establishes <br /> an appropriate level of local and state government <br /> oversight over utility facility placement. <br /> <br />12 <br /> <br /> <br />
