306.3 <br /> <br />306.4 <br /> <br />Provides greater flexibility for municipalities to <br />finance security enhancements to seaports, <br />airports and other transportation facilities. <br /> <br />Provides for information-sharing during the <br />planning process to determine the most cost <br />efficient route for transportation proiects. <br /> <br />306.5 <br /> <br />Provides for more equitable representation of <br />municipalities on Metropolitan Planning <br />Organizations and regional transportation <br />organizations, and provides for coordination <br />among municipalities and counties where there <br />are no Metropolitan Planning Organizations. <br /> <br />306.6 <br /> <br />Encourages the use of alternative modes of <br />transportation or modes that utilize alternative <br />fuels to help address such concerns as air quality, <br />mobility of people and goods, and other <br />transportation-related challenges. <br /> <br />306.7 <br /> <br />Prohibits any new increases in heavy truck weight, <br />length or size limits on interstate and non- <br />interstate highways to ensure public safety and <br />lessen infrastructure damage. <br /> <br />106.8 <br /> <br />Grants municipalities more control over general <br />traffic regulation, including the authority to enforce <br />traffic laws through the use of electronic traffic <br />infraction detectors and the authority to establish <br />speed limits on municipally maintained roads. <br /> <br />306.9 Enhances the role of municipalities in the <br /> placement of traffic control devices. <br /> <br />Public Property Management <br /> <br />307 <br /> <br />Public property and rights-of-way are of substantial <br />economic value and interest to local communities <br />and are control)ed by municipalities for the benefit <br />of the public and, in part, to facilitate the movement <br />of commerce. Municipalities are trustees of public <br />property and rights-of-way and, as such, engage in <br />a variety of activities, including granting franchises, <br />promulgating construction standards and issuing <br />permits. These activities are undertaken to <br />minimize service disruptions to the public, to <br />protect public investments in the rights-of-way and <br />to assure the appropriate placement of service <br />facilities. There should be no action by the <br /> <br />Legislature that restricts the authority of <br />municipalities to manage this public asset. <br /> <br />The Florida League of Cities will support legislation that: <br /> <br />307.1 <br /> <br />Ensures municipalities are able to prevent the re- <br />peated disruption of the public's use of streets by <br />establishing requirements for the placement and <br />use of conduit and other infrastructure in public <br />rights-of-way. <br /> <br />307.2 <br /> <br />Ensures municipalities may require those who <br />wish to use the rights-of-way to demonstrate their <br />qualifications, and ensures municipalities are able <br />to prevent unqualified entities from entering the <br />rights-of-way and creating hazards to the public <br />and to property. <br /> <br />307.3 <br /> <br />Ensures municipal authority to require that a rights- <br />of-way user obtain appropriate authorization to use <br />the rights-of-way for each specific service. <br /> <br />Utility and Communication Services <br /> <br />308 <br /> <br />Much like the deregulation of the telecommunications <br />industry in ~ 996, efforts are underway at the state <br />and federal levels to allow'increased competition <br />in the electric and gas utility industries. Municipal <br />officials recognize market and consumer pressures <br />exist for cost efficient utilities. They also recognize <br />the need for safe and reliable electric and gas <br />systems. It is paramount that restructuring the <br />delivery of electricity and gas does not interfere <br />with municipal authority to manage public rights- <br />of-way or to become utility aggregators. In <br />addition, municipalities should not be restricted <br />on the use of the funds generated from utilities, <br />nor be preempted from establishing rates for <br />providing such services. <br /> <br />The Florida League of Cities will support legislation that: <br /> <br />308.1 <br /> <br />Promotes establishing a methodology to equitably <br />allocate the costs associated with undergrounding <br />electric and other utility services among all parties <br />receiving an economic benefit from such <br />undergrounding. <br /> <br />308.2 Preserves municipal authority to provide <br /> communications services. <br /> <br />11 <br /> <br /> <br />
