Code Enforcement Hearing <br />Minutes, January 16, 2025 <br />Page 4 <br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony for case CE -24-002763, located <br />at 606 Desoto Drive. The property was reinspected and found to remain in violation on January 13, 2025. <br />The City requested a correction date of January 30, 2025. If there is no compliance by January 30, 2025, <br />then a fine of $75.00 per day, per violation should then be imposed for each day of non-compliance <br />thereafter. The City requested a subsequent hearing date of February 20, 2025, to determine compliance. <br />There was a representative present to speak about this case. <br />Discussion: Brett Brinkerhoff, 606 Desoto Drive stated the armoire and bookcase were removed, the car is <br />his daughters, and they will put a cover over it. Officer Hall stated a cover over the car would not close the <br />violation, since the City already knows the violation is there. The code also states the car would need to be <br />in a garage and not a carport. The Special Magistrate asked Mr. Brinkerhoff if he would be able to have <br />this in compliance by January 30, Mr. Brinkerhoff stated yes. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -24-0002763, <br />located at 606 Desoto Drive and was found in violation of City Code 3-10.3.c.6 and 3-10.9.f and if there is <br />no compliance a $75.00 per day, per violation fine will be imposed. The Respondent was given until January <br />30, to achieve compliance. A subsequent hearing will be held on February 20, 2025, to determine if <br />compliance has been achieved. <br />H. CE -24-0002892: 641 Kentia Road <br />Violations — City Code 3-10.3.a.4 Roofs, Gutters, Down Spouts — Maintenance <br />Staff Presentation: Marie Plaza, Code Compliance Officer gave testimony for case CE -24-002892, located <br />at 641 Kentia Road The property was reinspected and found to remain in violation on January 13, 2025. <br />The City requested a correction date of February 17, 2025. If there is no compliance by February 17, 2025, <br />then a fine of $100.00 per day should then be imposed for each day of non-compliance thereafter. The City <br />requested a subsequent hearing date of February 20, 2025, to determine compliance. There was no one <br />present to speak about this case, but a representative for the owner- did email a letter to the Special <br />Magistrate asking for an excision. <br />Discussion: The Special Magistrate asked what the City's position was on granting an extension. Micelania <br />Acevedo, Code Compliance Supervisor stated the City's position was for the property to be in compliance <br />by February 17, 2025, the reason is the permit has not been applied for. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -24-002892, located <br />at 641 Kentia Road and was found in violation of City Code 3-10.3.a.4 and if there is no compliance a <br />$100.00 per day fine will be imposed.
