Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />March 13, 2024 <br />Page 4 <br />Ms. Christine Fitzgerald, 481 Citrus Lane, came forward to speak about this item. <br />Ms. Melodee Comenzo, 1944 Water Lane, came forward to speak about this item. <br />Ms. Dan Jeancola, 465 Citrus Lane, came forward to speak about this item. <br />Ms. Ashlee Jones, 1910 Spruce Court, came forward to speak about this item. <br />Discussion: The Planning and Zoning Commission discussed this item further. <br />MOTION: Mr. Minnis moved that the Planning and Zoning Commission, acting as <br />the City's Local Planning Agency, recommend approval of Case number <br />FLU 24-03 to the City Commission based on the staff report and the <br />testimony and evidence presented, that the request meets the applicable <br />provisions of the Unified Land Development Regulations (ULDR) and is <br />consistent with the City's Comprehensive Plan as per the written <br />findings in the staff report. Mr. Curran seconded the motion. The motion <br />passed unanimously by voice vote. <br />9. PUBLIC HEARINGS <br />A. TZ 24-02: An Ordinance to Amend, Repeal, and Replace Various Sections of City <br />Code Relating to Noise and Nuisance Abatement. <br />Staff presentation: Ms. Antonia DeJesus, Chief Planner, and Mr. Matthew Linder, Planner I, <br />presented case number TA 24-02 to the Planning and Zoning Commission. Mr. Linder presented <br />background information on noise and sound. Ms. DeJesus addressed the Planning and Zoning <br />Commission and advised that the City has regulations in place to control excessively loud and <br />unusual noises that can negatively impact surrounding areas. She further noted that the current <br />Code needs to be updated to reflect the latest case law that provides additional guidance on the <br />constitutionality of noise codes. <br />On February 29, 2024, a notice of this public hearing was advertised in the Orlando Sentinel. The <br />proposed amendment aims to secure and promote the public health, comfort, welfare, and <br />prosperity of the City and its residents. <br />The proposed amendment makes three changes, which: repeal and replace City Code Section 58- <br />56, Unnecessary or Disturbing Noise, to update based on recent case law; amend City Code Section <br />2-210, Schedule of Violations; and repeal and replace paragraph G., Noise, of Unified Land <br />Development Regulations (ULDR) Section 3-17.4, Specific Standards for Nuisance Abatement. <br />Staff recommends that the Planning and Zoning Commission recommend approval of case number <br />TA 24-02 to the City Commission, based on the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the Unified Land Development <br />
