Residential uses shall be developed at a gross density <br />not exceeding 13 dwelling units per acre. The property at 2075 Howell Branch Road (the westernmost <br />parcel) was previously located in unincorporated Seminole County and was annexed into City limits on <br />February 26, 2024. <br />In addition to the rezoning, the 2075 Howell Branch Road property is currently undergoing a FLUM <br />amendment to Commercial. The 2035 Howell Branch Road property already has a Commercial FLUM <br />designation. Per the City's Comprehensive Plan, developments with CG (Commercial General) zoning are <br />intended to function within the Commercial FLUM designation. Components such as landscape buffers, <br />lighting, parking or connectivity will be assessed during the site plan review process. Staff feels that the <br />proposed zoning is compatible with adjacent land uses. Police services are provided to the subject property <br />by the City of Casselberry, and Seminole County currently provides Bre services. Vehicular and pedestrian <br />access will be provided via a driveway and sidewalk on Howell Branch Road. City water and sanitary sewer <br />services are available to the subject property. Given that the proposed use is nonresidential, a school impact <br />analysis for the development was not necessary. <br />Staff recommends that a favorable recommendation be provided from the Planning and Zoning Commission <br />to the City Commission for ZMA 24-03, based on the staff report and the testimony and evidence presented, <br />that the request meets the applicable provisions of the ULDR and is consistent with the City's <br />Comprehensive Plan as per the written findings in the staff report. <br />Discussion: Members of the Planning and Zoning Commission asked staff questions. Chairman Bakalla <br />then asked if there was a representative present to speak to this item. The applicant, Carlos Gregory 3101 <br />Zaharias Drive, Orlando, Florida, came forward and addressed the Commission. <br />Audience Participation: Chairman Bakalla asked if anyone in the audience wished to speak about this <br />item. A resident came forward to speak about this item. <br />Ms. Christine Fitzgerald, 481 Citrus Avenue, carne forward and addressed the Commission and stated her <br />concerns about this project, which included increased traffic at the intersection of Lake Howell Road and <br />Howell Branch Road resulting from the project. She also cited lighting and a general desire to see the <br />property remain as is. <br />MOTION: Mr. Bryan moved that the Planning and Zoning Commission, acting as the <br />City's Local Planning Agency, recommend approval of Case number ZMA 24- <br />03 to the City Commission, based on the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of the <br />ULDR and is consistent with the City's Comprehensive Plan as per the written <br />findings in the staff report. Mr. Lucas seconded the motion. The motion passed <br />unanimously by voice vote. <br />B. ZMA 24-04: An Ordinance to Amend the Official Zoning Map for Parcel 329 Seminola Boulevard. <br />Staff presentation: Matthew Linder, Planner I, presented item B. ZMA 24-04, a proposal to amend <br />the Official Zoning Map for a property located at 329 Seminola Boulevard. The subject property sits <br />adjacent to residential properties to the south and west and to the east just across the City -owned waterway. <br />Lake Kathryn is to the north of the subject property. The applicant purchased this property from the City in <br />June 2023. <br />
