Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />April 10, 2024 <br />Page 3 <br />meets the applicable provisions of the ULDR and is consistent with the Comprehensive Plan as per the <br />written findings in the staff report. <br />The proposed conditions of approval are as follows: <br />1. The site plan approval shall be valid for one (1) year; an extension request may be submitted <br />prior to the expiration of this approval. <br />2. Provide copies of all local, regional, state, and federal permits for the project to the City prior <br />to the commencement of development. <br />3. All the above conditions shall be fully and faithfully executed, or the site plan shall become null <br />and void. <br />Discussion: Members of the Planning and Zoning Commission asked staff questions. Ms. Antonia DeJesus, <br />Chief Planner, and Mr. Christopher Schmidt, Community Development Director, addressed questions from <br />the Commission. Chairman Bakalla asked the applicant to come up and speak to speak to this 'item. Mr. <br />Mike Kern, Civil Engineer located at 436 W. New York Avenue, Deland, Florida, addressed the <br />Commission on behalf of the applicant <br />Audience Participation: Edmund Bakalla, Chairman asked if there was anyone in the audience to speak <br />about this item. No one carne forward to speak about this item. <br />MOTION: Mr. Bryan moved that the Planning and Zoning Commission, acting as the <br />City's Local Planning Agency, recommend approval of Case number SPR 24- <br />04 to the City Commission, based on the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of the <br />ULDR and is consistent with the City's Comprehensive Plan as per the written <br />findings in the staff report. Ms. Stanley seconded the motion. The motion <br />passed unanimously by voice vote. <br />8. FUTURE LAND USE MAP AND ZONING MAP <br />AMENDMENTS <br />A. ZMA 24-03• An Ordinance Amending the Official Zoning Map for 2075 and 2035 Howell Branch <br />Road <br />Staff presentation: Hunter McFerrin, Planner I, presented ZMA 24-03, a zoning amendment for two <br />parcels located at the intersection of Lake Howell Road and Howell Branch Road. The request would amend <br />the City's Official Zoning Map for the property with the Parcel Identification Number 28-21-30-300-0280- <br />0000, from Seminole County OP (Office Professional) to City of Casselberry CG (Commercial General), <br />and the property with the Parcel Identification Number 28-21-30-538-0000-0020, from City of Casselberry <br />OR (Office Residential) to City of Casselberry CG (Commercial General). Of the two parcels, the <br />easternmost is already in City limits, while the westernmost parcel was annexed into the City of Casselberry <br />on February 26, 2024, via Ordinance 24-1591. The applicant is requesting a zoning map amendment to <br />establish City of Casselberry entitlements to the property that will support a commercial retail plaza. <br />The proposed amendment to the Official Zoning Map is consistent with the following Comprehensive Plan <br />Policies and Objectives, Objective FLU 1. Coordinate Future Land Use. and Policy FLU 1.8. Properties <br />designated Commercial shall be developed at a Floor Area Ratio no greater than 0.25. A Floor Area Ratio <br />
