CASSELBERRY CITY COMMISSION <br />Minutes of December 16, 2024 — Regular Meeting <br />Page 16 of 21 <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 24-1616. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 24-1616. Mayor Henson closed the public hearing relative to <br />Ordinance 24-1616. <br />MOTION: Commissioner Busch moved to adopt Ordinance 24-1616 on second and final <br />reading, as presented. Motion was seconded by Commissioner Divita. Motion <br />carried unanimously by voice vote 5-0. <br />12. OTHER ITEMS <br />A. Amendment No. 1 to Supplemental Agreement No. 6 with Wharton -Smith, Inc. for <br />a Guaranteed Maximum Price to Construct Dew Drop Park and Related Budget <br />Amendment #25-011 <br />Staff Presentation: Special Projects Manager Martin Butcher gave an overview of this item which is a <br />request for approval of Amendment No. 1 to Supplemental Agreement No. 6 with Wharton -Smith, Inc. for <br />Construction Manager at Risk (CMAR) for Parks Construction projects for a guaranteed Maximum Price <br />(GMP) in the amount of $3,967,816, to construct Project PW 2110 Dew Drop Park Improvements and <br />related Budget Amendment 425-011 totaling $4,277,858 to provide for the GMP, a contingency of $73,478 <br />and funds for direct purchase of playground and exercise equipment of $236,564. The project will include <br />new elements such as a multi -use trail, ADA compliant playground, fitness equipment, new renovated <br />pavilions, tennis court, basketball court, renovated volleyball court, fishing pier, observation deck, sensory <br />garden, educational rain garden, new renovated restrooms and new lighting. The GMP in the amount of <br />$3,967,816 contains a 3% contingency of $110,217 for owner direct purchases in case of unanticipated <br />additional work. The City will also set aside an additional 2% contingency of $73,478.20 that will not be <br />included with the GMP but will be separate. Budget Amendment #25-011 is necessary to provide sufficient <br />funding for the GMP additional contingency of 2% and funding in the amount of $236,564 to cover City <br />direct purchases outside the Owner Direct Purchases (ODP) which includes some of the fitness equipment <br />and similar items. Funding for this project will include the Land Water Conservation Fund grant of $1.5 <br />million, the Recreation Impact Fee of $6,949, and the remaining balance of $2,770,901 will come from the <br />General Fund. If approved, Wharton -Smith will issue a Notice to Proceed on January 7, 2025 and has <br />provided a construction start of the end of January to the beginning of February 2025, a substantial <br />completion date of January 7, 2026, and an anticipated final completion date of March 11, 2026. The <br />timeline for construction will be 366 days from Notice to Proceed and 63 days from substantial to <br />completion. This will be a total of 429 days for construction. hl response to a question from the <br />Commission, Mr. Butcher advised that Wharton-Sinith is fully aware of the time requirements of the grant <br />money and are confident there will be no problem with completing the project within that timeframe. In <br />response to additional questions from the Commission, Mr. Butcher and IT Manager Ed DeJesus advised <br />that there would be surveillance cameras installed for the project and the initial number discussed some <br />time ago was six, but it was believed there would most likely be more. <br />
