Recommendation: The City Manager, the City Clerk and the Public Works Director recommended adoption of Ordinance 24-1614 on second and final reading. Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and questions regarding Ordinance 24-1614. Mayor Henson opened the floor for public participation. No one came forward to address Ordinance 24-1614. Mayor Henson closed the public hearing relative to Ordinance 24-1614. MOTION: Commissioner Divita moved to adopt Ordinance 24-1614 on second and final reading, as amended to increase the board membership from five to seven members. Motion was seconded by Commissioner Kirk. Motion carried unanimously by voice vote 5-0. C. Public Hearing: Second Reading of Ordinance 24-1612 — Amending City Code, Chapter 14, Section 14-51, Permit Application and Section 14-54, Seasonal Sales; Performance Criteria The City Clerk read Ordinance 24-1612 by title, as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF CASSELBERRY CODE OF ORDINANCES, CHAPTER 14, "AMUSEMENTS,", ARTICLE 1I, "SPECIAL EVENTS, OPEN AIR SALES, OPEN AIR FOOD SALES, SEASONAL SALES, AND TEMPORARY STRUCTURES", SECTION 14-51, "PERMIT APPLICATION" AND SECTION 14-54, "SEASONAL SALES; PERFORMANCE CRITERIA," TO REFINE RELATED RULES AND REGULATIONS FOR SEASONAL SALES PERMITS TO ENSURE QUALITY, EFFICIENT, AND SAFE EVENTS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFCTIVE DATE." Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 24-1612 was advertised in the Orlando Sentinel on Thursday, December 5, 2024. Staff Presentation: Chief Planner Antonia DeJesus gave an overview of Ordinance 24-1612 which amends City Code Chapter 14, Article I1, Division 3, Section 14-51, Permit Application, and Section 14- 54, Seasonal Sales; Performance Criteria, to update permission language and refine related rules and regulations for seasonal sale permits. The ordinance was approved on first reading by the Commission on November 18, 2024. A detailed staff report containing the criteria was provided to the City Commission in their agenda packets for review prior to the meeting. Budget Impact: There is no impact to the City Budget. Recommendation: The City Manager and the Community Development Director recommended adoption of Ordinance 24-1612 on second and final reading.
