CASSELBERRY CITY COMMISSION <br />Minutes of December 16, 2024 — Regular Meeting <br />Pagc 11 of 21 <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Police Chief recommended approval of Ordinance 24-1617 <br />on first reading. <br />Audience Participation: No one came forward to address Ordinance 24-1617. <br />MOTION: Vice Mayor Aramendia moved to approve Ordinance 24-1617 on first <br />reading, as presented. Motion was seconded by Commissioner Kirk. Motion <br />carried unanimously by voice vote 5-0. <br />11. PUBLIC HEARINGS <br />A. Public Hearing: Second Reading of Ordinance 24-1613 — Amendments to the <br />Unified Land Development Regulations, Regarding Trees and Aquatic Plants <br />The City Clerk read Ordinance 24-1613 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART III OF <br />THE CITY CODE OF ORDINANCES, UNIFIED LAND DEVELOPMENT REGULATIONS, <br />CHAPTER III, PERFORMANCE CRITERIA, ARTICLE XI, ENVIRONMENTAL <br />PROTECTION, APPENDIX A, TO UPDATE AQUATIC PLANT SPECIES AND REFERENCES, <br />AND AMENDING ARTICLE XIII, LANDSCAPING, SECTION 3-13.4; AMENDING ARTICLE <br />XIV, TREE PROTECTION, SECTION 3-14.3, PERMIT REQUIRED FOR REMOVAL, PERMIT <br />EXEMPTIONS, AND EXEMPTIONS FROM REPLACEMENT REQUIREMENTS, TO UPDATE <br />BASED ON STATUTORY CHANGES; REPEALING SECTION 3-14.4, ESTABLISHMENT OF <br />CITY TREE ADVISORY COMMITTEE (CTAC); AMENDING SECTION 3-14.6 AND 3-14.7, TO <br />UPDATE TREE SPECIES REFERENCES AND RECOMMENDATIONS; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 24-1613 <br />was advertised in the Orlando Sentinel on Thursday, December 5, 2024. <br />Staff Presentation: Public Works Director Dr. Kelly Brock gave an overview of Ordinance 24-1613 which <br />amends the environmental protection, landscaping and tree protections sections of the Unified Land <br />Development Regulations (ULDR). This item is being primarily brought forward to repeal the City Tree <br />Advisory Committee, but some cleanup was also done relating to the tree and plant related sections. The <br />key duties of the City Tree Advisory Committee are proposed to be transferred to the Parks and Recreation <br />Advisory Board, and that proposal will be addressed through a separate ordinance in the next agenda item. <br />Ordinance 24-1613 also updates plant and tree references and lists, and updates tree permit removal <br />requirements and exemptions to better align City Code with Florida Statutes. The ordinance was approved <br />on first reading by the Commission on November 18, 2024. <br />Budget Impact: There is no budget impact associated with this item. <br />
