CASSELRE,RRY CITY COMMISSION <br />Minutes of December 16, 2024 — Regular Meeting <br />Pagc 10 of 21 <br />Staff Presentation: Community Development Director Christopher Schmidt gave an overview of <br />Resolution 24-3479 which approves the conveyance of approximately two (2) acres of real property located <br />on Wilshire Boulevard to Seminole County for the construction of a new fire station. This resolution is the <br />companion resolution to Resolution 24-3477 approving Amendment 2 to the Fire and Emergency Medical <br />Services hrterlocal Agreement with Seminole County and the Purchase and Sale Agreement for the subject <br />property which was considered and approved by the Commission in the agenda item immediately preceding <br />this item. <br />Audience Participation: No one came forward to address Resolution 24-3479 <br />MOTION: Commissioner Busch moved to approve Resolution 24-3479, as presented. <br />Motion was seconded by Vice Mayor Aramendia. Motion carried unanimously <br />by voice vote 5-0. <br />1.0. FIRST READING OF ORDINANCES <br />A. First Reading of Ordinance 24-1617 — Repealing in Its Entirety Article III <br />"Peddlers, Solicitors, Begging and Panhandling" of Chapter 26, Businesses" of the <br />City Code of Ordinances <br />The City Clerk read Ordinance 24-1617 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; REPEALING IN ITS <br />ENTIRETY ARTICLE III, "PEDDLERS, SOLICITORS, BEGGING AND PANHANDLING" OF <br />CHAPTER 26, `BUSINESSES" OF THE CITY CODE OF ORDINANCES; PROVIDING FOR <br />CODIFICATION; CONFLICTS, SEVERABILITY; AND AN EFFECTIVE DATE." <br />Staff Presentation: City Attorney Kristin Eick, with input from Police Chief Larry Krantz, gave an <br />overview of Ordinance 24-1617 which repeals in its entirety Article III, "Peddlers, Solicitors, Begging and <br />Panhandling" of Chapter 26, `Businesses" of the City Code of Ordinances. This is due to recent case law <br />that has been approved by the federal courts and calls into question the constitutionality of some of the <br />provisions in these ordinances. Therefore, the City Attorney and the Police Chief are reconnnending that <br />it be repealed in its entirety. Chief Krantz added that the City is continuing to address some of the issues <br />that are not specific to panhandling with statutory provisions under the traffic statutes that would apply to <br />any pedestrian who enters a roadway in a manner that would impede traffic, but as to specific issues with <br />panhandling, that the City is not able to enforce those types of issues under the current ordinance. He added <br />that the Police Department is still attempting to educate the public, and work with the homeless community <br />to understand what issues they are dealing with and offer access to various community resources that could <br />provide opportunities for solutions to some of those issues. The Police Department also tries to educate <br />these individuals to the dangers they are causing to themselves and others, especially in sorne of the larger <br />intersections with such high traffic volumes at relatively high speeds. He stated the Department continues <br />to make ongoing efforts to educate and provide resources to these individuals. The Commission agreed as <br />a whole that if the City is unable to enforce the ordinances currently in the Code relating to these issues, <br />they should definitely be removed. <br />
