Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />February 14, 2024 <br />Page 3 <br />As mentioned previously, the property was annexed in December 2023 and currently holds a <br />Seminole County FLUM designation and zoning district. This request intends to assign a <br />Casselberry FLUM of Major Thoroughfare Mixed -Use (MTMU). According to the <br />Comprehensive Plan Policy FLU 8.1 and Policy FLU 1.5, areas with MTMU land use have been <br />designated along the majority of U.S. 17-92 and S.R. 436. This FLUM designation is intended to <br />promote high-density, mixed-use development that will transform those corridors. <br />Staff has considered the surrounding properties' future land uses and the comprehensive plan and <br />finds that Major Thoroughfare Mixed -Use (MTMU) is the most appropriate FLUM designation <br />for the property and is harmonious with the surrounding properties. Upon redevelopment, the <br />property will welcome desirable development harmonious with existing businesses on the S.R. <br />436 corridor. The property has been under a pre -annexation agreement in which the City agrees to <br />provide utilities on the condition the property be annexed in the future, which has been fulfilled. <br />So, there is no change to the city's utility map or utilization of services. <br />No development is being proposed or has been proposed for the subject property at this time. <br />Rather, the annexation, establishment of FLUM designation, and zoning district have been an <br />administrative process to bring the property into the City per the pre -annexation utility agreement <br />and prepare it for future development. Any changes will be subject to a complete Planned Unit <br />Development (PUD) review consisting of a concept plan and PUD agreement. <br />Staff recommends the approval of case number FLU 24-02 by the Planning & Zoning Commission <br />to the City Cor- mission 'based on the staff report and the testimony and evidence presented that <br />the request meets the applicable provisions of the Unified Land Development Regulations (ULDR) <br />and is consistent with the City's Comprehensive Plan as per the written findings in the staff report. <br />Discussion: Members of the Planning and Zoning Commission asked staff questions. Chairman <br />Bakalla asked if a representative was present to speak to this item. There was no one present for <br />this item. <br />Audience Participation: Chairman Bakalla asked if there was anyone in the audience to speak <br />about this item. No one came forward to speak about this item. <br />MOTION: Mr. Bryan moved that the Planning and Zoning Commission, acting as <br />the City's Local Planning Agency, recommend approval of case number <br />FLU 24-02 to the City Commission, based on the staff report and the <br />testimony and evidence presented, that the request meets the applicable <br />provisions of the Unified Land Development Regulations (ULDR) and is <br />consistent with the City's Comprehensive Plan as per the written <br />findings in the staff report. Mr. Kirk seconded the motion. The motion <br />passed unanimously by voice vote. <br />
