These things considered, staff feels that the proposed FLUM amendment is <br />compatible with adjacent land uses. <br />Police services are provided to the subject property by the City of Casselberry, and Seminole <br />County currently provides fire services. Upon developing the property, vehicular and pedestrian <br />access will be provided via a ±50 ft. easement on 1085 Belle Avenue, which the applicant also <br />owns. Adequate City water and sanitary sewer services are available to the subject property, which <br />was recently verified through hydraulic modeling. The applicant has submitted a school impact <br />analysis for the proposed townhomes indicating the added capacity can be easily accommodated <br />by SCPS. <br />The proposed amendment to the Future Land Use Map is not anticipated to have any negative <br />effect on the natural environment, as the site is not located in a floodplain and there are no wetlands <br />on the property. The proposed FLUM amendment requires that the property be rezoned to a zoning <br />district that is consistent with Medium Density Residential (MDR). The applicant intends to rezone <br />to RMF -13 (Medium Density Multifamily), satisfying this requirement. Plans to develop the <br />subject properties will be reviewed and shall adhere to the requirements of the ULDR and Code of <br />Ordinances. <br />Staff recommends that the Planning and Zoning Commission recommend approval of case number <br />FLU 24-01 to the City Commission, based on the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the ULDR and is consistent with the <br />City's Comprehensive Plan as per the written findings in the staff report. <br />Discussion: Members of the Planning and Zoning Commission asked questions of staff and the <br />Applicant for case FLU 24-01, a lengthy discussion ensued. Chairman Bakalla asked about the <br />access easement and whether it was going to be a private road. Hunter McFerrin advised that it has <br />not been determined. Chairman Bakalla also asked about notification for the surrounding areas. <br />Antonis DeJesus advised that the requirement was for 500 feet, regardless of jurisdiction. <br />Chairman Bakalla then asked the applicant to come forward. Bob Ziegenfuss of Z Development <br />Services located at 1201 E Robinson Street, Orlando, Florida came forward and addressed the <br />Commission. Mr. Ziegenfuss wanted to clarify some of the discussion, stating that the property <br />owner also owns the property to the west, the unimproved right-of-way known as David Drive. <br />They have spoken to the County, specifically the Parks Department, and they asked that there are <br />no impediments in the way for future trails. A use permit would be obtained from Seminole <br />County, in order to use the right-of-way to cross over it. <br />Audience Participation: Chairman Bakalla asked if there was anyone in the audience that wanted <br />to speak about this item. There were several citizens that wanted to speak about the item. <br />1. Christine Barrett, 249 Buttonwood Avenue, Winter Springs, FL expressed her concerns <br />about where the access to the parcel would be. Ms. Barrett was told the access would be <br />from Belle Avenue. <br />2. Roger Hibbs, of Buttonwood Avenue, Winter Springs, FL stated that the back of his fence <br />backs up to the property and there is "nothing but garbage back there." Mr. Hibbs also <br />
