The site plan approval shall be valid for one(]) year An extension request maybe <br />submitted prior to the expiration of this approval. <br />2. Additional on-site lighting shall not be installed without review and approval of a <br />proposed photometric plan by the City. <br />3. The applicant shall ensure that the landscaping along S.R. 436 is maintained in <br />perpetuity for screening purposes. <br />4. Provide copies of all local, regional, state, and federal permits for the project to <br />the City prior to commencement of development. <br />5. All of the above conditions shall be fully and faithfully executed, or the site plan <br />shall become null and void. <br />Discussion: Chairman Bakalla asked if the applicant would come forward. Mr. Rashid H. <br />Jamalabad, P.E, CGC, with RJ Engineering, LLC, 4455 Sunset Lane, Oviedo, Florida, came <br />forward and briefly addressed the Planning and Zoning Commission. <br />Audience participation: No one came forward to address this item. <br />Discussion: Jennifer Nix, Assistant City Attorney, asked whether there were four or five <br />conditions, as there are five conditions of approval in the staff report and four on the PowerPoint. <br />Mr. Linder stated there are five, item number three on the conditions of approval in the staff report <br />was not present in the PowerPoint presentation and is still part of the recommendation in the staff <br />report. <br />MOTION: Mr. Bryan moved to approve SPR 23-01, Major Site Plan Approval at <br />945 S.R. 436 based upon the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the City <br />Code of Ordinances and the Unified Land Development Regulations <br />(ULDR) and is consistent with the Comprehensive Plan as per the <br />written findings contained within the staff report, subject to conditions <br />1-5. Motion was seconded by Mr. Minnis. The motion passed <br />unanimously by voice vote. <br />2. SPR 23-19: Major Site Plan Approval for Panda Express located at 1393 S.R. <br />436 <br />Staff Presentation: Hunter McFerrin, Planner I, presented to the Planning and Zoning <br />Commission case number SPR 23-19. He first stated that the applicant is requesting site plan <br />approval to make improvements to the existing drive-through on the property located at 1393 S.R. <br />436 and to construct an accessory parking lot on the adjacent property, 1391 S.R. 436. The <br />combined parcel size is ±1.28 acres. Further, the property is in the PMX-MID (Planned Mixed - <br />Use: Medium Rise) zoning district with a Future Land Use Map (FLUM) designation of Major <br />
