Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />August 9, 2023 <br />Page 6 <br />garage and a 1,076 sq. ft. Accessory Dwelling Unit (ADU) on the residential property located at <br />141 Sunnytown Road. The subject property has a zoning designation of R-9 (Low Density Single - <br />Family) and a Future Land Use Map (FLUM) designation of Low Density Residential (LDR). It <br />is larger than most residential lots, at about .6 acres. The applicant is requesting this conditional <br />use to allow for the construction of an ADU and detached garage as a living space for her parents. <br />The conditional use is required as both are over 500 sq. ft. As noted previously, the ADU is just <br />over 1,000 sq. ft. and is planned to be a 2 -bed, 2 -bath dwelling unit. The second building is a 600 <br />sq. ft. detached metal garage. The garage is 20 x 30 and will provide parking spaces and storage <br />for the ADU. Planning has limited the ADU's kitchen to allow for a complete dwelling unit while <br />ensuring that it is ancillary to the existing home. All surrounding properties to the north, south, <br />and west are single-family residential homes. <br />To the east, the subject property abuts a parking lot on a commercial property. The proposed use <br />is compatible with the surrounding land uses and will not adversely impact land use activities in <br />the immediate vicinity. The proposed structures meet all setback and buffer requirements, and the <br />detached garage provides the required number of parking spaces generated by the ADU. Both <br />structures will be in the rear yard of the property and will blend aesthetically with the principal <br />structure. Renderings of the ADU provided by the applicant were shown to the Commission. No <br />waste will be present on the property, and the applicant will be required to obtain a permit for the <br />proposed work. Staff recommended that case number CU 23-09 be approved with staff's <br />conditions, based upon the staff report and the testimony and evidence presented, that the request <br />meets the applicable provisions of the Unified Land Development Regulations (ULDR) and is <br />consistent with the Comprehensive Plan as per the written findings contained within the staff <br />report. <br />Conditions: <br />The conditional use shall be limited to the location of 141 Sunnytown Road. <br />2. The accessory structure shall not be utilized for any commercial activity or home <br />occupation. <br />3. The ADU shall not be utilized for any commercial activity. <br />4. The accessory structure shall be utilized solely for storage and shall not be converted to a <br />habitable structure. <br />5. Any additions that increase the height or square footage of the accessory structure or <br />ADU will require conditional use approval. <br />6. A building permit must be issued within 180 days of approval. All inspections must be <br />approved by the expiration date of the building permit. <br />7. The use shall remain in complete compliance with all City, County, and State <br />requirements. <br />
