Outdoor seating shall not commence without prior site plan approval according to ULDR <br />Article XVIII, Site Plan Review. <br />3. All sales and consumption of alcoholic beverages, except for approved package sales, <br />shall be on-site and indoors or confined to outdoor seating areas as part of an approved <br />site plan per ULDR Article XVIII, Site Plan Review. <br />4. Sale of alcoholic beverages is prohibited when food service is unavailable, and at least <br />51 % of gross revenue shall be derived from the sale of food and nonalcoholic beverages. <br />S. The hours of on-site alcohol consumption and sales shall comply with the hours outlined <br />in Section 10-2 of the City of Casselberry's Code of Ordinances. <br />6. The business shall comply with all City, County, and State requirements. <br />7. An engineering permit to increase the number of ADA -accessible parking spaces to <br />comply with ULDR Article XV, Off-street Parking and Loading Requirements, must be <br />submitted within 180 days of the conditional use approval. <br />8. The conditional use shall commence within 180 days of the approval. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed, or the conditional use <br />shall become null and void <br />Discussion: Commission discussion ensued, and Chairman Bakalla asked if the applicant would <br />come forward, the applicant was present and came forward. Iliana M. Araujo Gutierrez briefly <br />addressed the Planning and Zoning Commission. <br />Audience Participation: No one came forward to address this item. <br />MOTION: Mr. Minnis moved to approve CU 23-07, Conditional use request at 863 <br />S.R. 436 based upon the staff report and the testimony and evidence <br />presented that the request meets the applicable provisions of the City <br />Code of Ordinances and the Unified Land Development Regulations <br />(ULDR) and is consistent with the Comprehensive Plan as per the <br />written findings contained within the staff report, subject to the <br />conditions 1-10 as presented. Motion was seconded by Mr. Bryan. The <br />motion passed unanimously by voice vote. <br />C.
