CASSELBERRY CITY COMMISSION
Minutes of March 12, 2001 - Regular Meeting
Page 12 of 19
6. FIRST READING OF ORDINANCE 01-1013 - COLTON ANNEXATION
MOTION: Commissioner Clark moved to read Ordinance 01-
1013 by title only. Motion was seconded by Vice
Mayor Henson. Motion carried unanimously by
voice vote.
The City Clerk read Ordinance 0 1- 10 13 by title as follows:
"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO
VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND
INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF
CASSELBERRY, FLORIDA, CERTAIN LANDS LOCATED IN SECTION 28,
TOWNSHIP 21 S, RANGE 30E; REDEFINING THE CORPORATE LIMITS OF THE
CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR THE INTERIM PROVISION
OF LAND DEVELOPMENT REGULATIONS; PROVIDING THAT CERTAIN
COUNTY LICENSEES FOLLOWING THEIR BUSINESS, TRADE OR PROFESSION
WITHIN THE LANDS TO BE ANNEXED MAY CONTINUE TO FOLLOW SUCH
BUSINESS, TRADE OR PROFESSION THROUGHOUT THE ENTIRE CORPORATE
LIMITS WITHOUT THE NECESSITY OF FURTHER QUALIFICATION
THEREFORE; PROVIDING THAT EFFECTIVE AS PROVIDED BY LAW, THE
LANDS TO BE ANNEXED SHALL BE ASSES SED FOR PAYMENT OF MUNICIPAL
AD VALOREM TAXES; DIRECTING THE CITY CLERK TO FILE CERTIFIED
COPIES OF THE ORDINANCE WITH THE CLERK OF COURT AND THE
SECRETARY OF STATE OF THE STATE OF FLORIDA; AND PROVIDING FOR
CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE."
Mr. Wells stated Ordinance 01-1013 provided for voluntary annexation of 1.1 acres known as the Colton
property located on the northwestern corner of the intersection of Anchor Road and Melody Lane. The
annexation will not create an enclave and generally meets the statutory requirements of Chapter 171. The
property is currently occupied by Photochemical Systems of Florida and Nazdar, a printing ink supplier. Both
companies are located in the same building and preform light manufacturing and distribution functions. Staff
recommended approval of Ordinance 01-1013 on first reading.
Commissioner Sheppard noted that Appendix B, C, and D of the staff report contained the correct maps, but
incorrectly listed the subject property as properties at Lake Howell Lane and Lake Howell Road intersection,
and requested that they be corrected. Mr. Wells stated the appendixes would be corrected to reflect the
correct descriptions prior to the public hearing.
MOTION: Commissioner Clark moved to approve Ordinance
01-1013, on first reading, as amended. Motion was
seconded by Vice Mayor Henson. Motion carried
unanimously by roll call vote.
